Was the Assessor's decision by email? Just copy & paste it here.

If by post, and you have no scanner, take a photo of the letter on your phone and then host the picture on tinypic and then post the URL into a reply here.

Nice result, i suppose you cold tell them to stick their permits where the sun doesn't shine and if they chose to keep ticketing then it will be popla each and every time.

I think that it is a cop out. I am about to purchase a BTL in a block policed by a PPC.

The Second Schedule of the lease grants the following Right and Privilege

5. The right of the leaseholder and all persons authorised by the leaseholder at all times for all purposes incidental to the occupation and enjoyment of the Premises to park a single motor vehicle in sound and roadworthy condition etc., etc., etc.

It makes no mention of having to jump through a parking pest's hoops.

If the PPC were to harass a tenant I would be inclined to write to them cancelling the ticket and invoicing them for £27.

Or go one step further as someone did against ukpc and sue them for trespass.

• Krrd9 - good result from POPLA.
However I read this thread from start to end last night (as it started before I joined forum) and I am surprised that:

a) why you and your daughter let this charade go on - I certainly would not as other posters commented before entertain the situation . Your daughter is the freeholder and her neighbour does not have legal authority to make or instruct third party negotiations over her property. (I bet he was also promised a back-hander)

b) why you were doing this for your daughter - surely as she owns her own property she needs to be able to stand on her own two feet at some point.

c) I would now be thinking of sending the PPC a Personal Costs Notification of my own for damages to the PPC (and possibly the neighbour).

(This has been done before and features on Prankster blog)

I think the more these shysters are hit with a Personal Costs Notification - especially where POPLA has adjudicated in the motorist's favour - the more they might think twice about indiscriminate ticketing.

What's sauce for the goose......... And why not?

The Deep - good plan - I would go one step further after purchase though

Write to PPC stating you are now the legal leasehold owner of xxx and parking bay. You have not authorised the PPC to conduct their business and your lease does not contain grant any authorisation.

For every Parking charge notice on your bay - you will charge a tresspass fee of £200. Should they fail to pay then further charges will be added including a process fee of £27 to deal with initial administration costs. Legal action will then commence for further non-payment.

Good luck with your BTL - highlight no liability to pay charge in AST for tenant
:)

Maybe you can offer them POPLA for dispute resolution :rotfl:

You are probably correct in your point b, but then you could say the same for everyone who seeks advice on consumer forums.
