Thanks for all the help. Is it possible for someone to sign a contract on my daughters behalf if she verbally agreed to it?

    Absolutely not.
It will be a self ticketing and one of her neighbours will have put the ticket on as they get a small cut.
I would go all guns blazing and knock on each and every door until I found them, then give them a very stern verbal warning that if they trespass on the land ever again you will have them arrested for aggravated trespass as they have now been warned to keep off it.
Then tell them they are also liable for the actions of this parking company they employed and the claim for harassment will be arriving in a letter before action next week.
make it quite clear you dont give a stuff what they say, it is your land
    Be happy...;)

Not that I'm aware of - how could the PPC prove that ? So Ms X, this contract is signed by Mr Y - it must have been done on your behalf !

Just so you know for next time - she appealed too soon - should always wait for the postal Notice to Keeper. But never mind, her position is still strong. Read threads about how to word a strong POPLA appeal, in readiness.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Been to my Daughters tonight and checked her deeds, the Land Registry plan clearly shows the 2 parking spaces designated are registered to her, in fact her land extends all the way to the front boundary fence, so to get to some of the other bays the ppc would have to cross her land. She went and asked the gentleman who organised the scheme and asked to see the contract, he said there isn't one, he thinks the company (Parking Ticketing Ltd) just gave him a leaflet. To be fair he seems quite a genuine chap who had just had enough of rougue parkers, and intends to not do the same next year (bit strange if there is no contract). My Daughter has definately not signed a contract and has never received any paperwork to suggest she has one. Should her next step be to ask PTL for evidence of a contract to support her appeal, or just appeal to POPLA without it, and should she request that PTL do not put parking charge requests on cars parked in her spaces.
  • appeal directly to popla

She should in the appeal put the operator to proof that a contract exists.
Also she should ask them to prove their losses. They wont show a contract that doesnt exists:), and most wont show it anyway.

you should also go on the offensive with this as per the link give above:
    http://www.consumeractiongroup.co.uk/forum/showthread.php?377246-UKCPS-liable-for-trespass

What your daughter should concentrate on doing is the popla appeal as above and a letter before action against the parking company advising they will be sued for trespass in the small claims court if they persist :)

I would deliberately ignore them and the permit.
Put the tickets in the bin.

Would the fact that apart from the night she got the PNC, she has displayed a permit, suggest that she must have thought a contract was in place?

Could I put a contract in place on your house that says you have to pay me £100 every time you open the front door ?
    Be happy...;)
