Thanks earthstorm, I am just sitting back now to see what happens next.
Their last email was this morning, stating that they contacted a UK solicitor yesterday. Previous emails had the subject 'HP computer', but this latest one has the subject 'HP computer (without prejudice)' .....
as said earler, how on earth did they contact a UK solicitor on a bank holiday? unless there is the odd bent one who is on standby to all the ne'er-do-wells who are still in Spain and haven't yet moved to Northern Cyprus.
Also I think they don't have a leg to stand on as they did not complain to you in the first place and allow you to sort out any problem. By going straight to a local repairer they have rather shot themselves in the foot. The questions that get the best answers are the questions that give most detail....0 -
Thanks again for recent comments, and I agree with you :-)
'Some' of their comments may have been a result of them not understanding laptops. eg. components from different manufacturers and some components being old.
I 'could' interpret this as acceptable, since a laptop consists of hundreds of components, which typically come from various manufacturers. HP just brings them together into a HP-badged laptop.
Regarding the 'old' components, this could relate to the CPU being an old-generation one. This is an entry-level laptop after all. Is like buying a Ford Focus car - the Focus 'model' is old, but you can still buy a 'new' car.
I also totally agree that they should not have gone to a repair shop without contacting me first. Was bad enough that they waited 4 months before contacting me, but then I have no idea who the 'local repair shop' is, nor what 'they' may have done to the laptop. There are 10 types of people in the world. Road-Hog I believe you are actually trying to wind people up rather than add to debates now and I tend to skim your posts only. your post ignores the fact that OP says he has been threatened with a solicitor- it is immaterial what the legalities are, we are addressing points raised by the OP not by the buyer.
By all means continue to be as litigious as you wish
I think that that is reasonably important and really not something that should be dismissed lightly, especially if it ever did get legal, but once again, ignore advice from someone who has experience of legalities and onto the rest of my post.
Well, perhaps it would be better if you actually properly read my posts and then you might understand me better. I'm not trying to wind people up, I'm trying to save them money and give them good advice.
Yes, the OP might have been threatened by the buyer, of having a solicitor, but that means nothing, it is a civil matter and 99% of the time nothing comes of it. Worst case, it goes to county court, like I've said in other posts, it isn't a court in the traditional sense, no men in wigs, just a big office, some bloke behind a desk and you and the other person giving your side of the story.
Now, you can be represented by a solicitor, but it's a bit of a waste of time and if the other side use a solicitor it isn't a problem. The judge will listen to both sides, in fact he won't be impressed with a solicitor, because the whole idea of the small claims court is to keep costs down.
We need to understand we're talking civil law, not criminal law, no men in wigs and words like, 'take him down', no police etc.
All I'm trying to do, is say, don't get lawyers involved unless you have to do, because they'll take all your money. The small claims court is great because it is cheap, but just because you're in the right, it doesn't mean you'll get your money.
I've never said I've been litigious over ebay, my dealings with lawyers have been nothing to do with ebay, what I actually said was, I challenged ebay/paypal on two occasions over their dealings with me, and asked them to take me to court, because I felt that they fell foul of British law. They decided not to take me up on my offer, which led me to believe that they had broken the law or at the very least, had such a weak case, it wasn't worth pursuing.0 -
I understand you may be excited about having been in court recently, but it's not of interest or relevant to the op and it's getting rather tedious in post after post that you comment on. You aren't the first and you won't be the last, get over it.
The OP has all the info they need, they don't need the ins and outs of your life history.0 -
I've not heard back from them yet...
Either they have given up, or they are in contact with their solicitor.
I will update if/when I hear more....There are 10 types of people in the world. Those who understand binary, and those who don't!0
