    If the landowner is Savilles, I have heard of at least one case where they were very helpful towards a genuine customer and got the charge cancelled with very little effort.
    I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.
  • Coupon mad, I tried the phone number but it says not recognised. I have a sneaking suspicion it was an old Excel number anyway. As for those links, thank you very much for taking the time to look but unfortuantely those are to do with Teesside Retail Park which is a different place. Confusing I know.

    In the notice to keeper what do they say about appealing. Do they ask for the name of the motorist?

    Not when I looked. Read down to the bottom where both links also talk about Middlesbrough Leisure Park specifically - which I took to mean as a possibility that Savills runs/owns that place too. Savills are usually very helpful with kicking rogue PPCs into touch where a park turns out to be one of theirs.

    Have you got a reply and POPLA code from Excel yet? Should have done. If they have sent a rubbish letter asking for the driver you must respond, NOT giving the driver but demanding the POPLA code.

  • Hi coupon-mad, sorry for the lack of reply, been waiting for Excel to sort themselves out. I've received two letters from them, within the space of a few weeks, both in different format but both basically saying they are currently dealing with my soft appeal. They haven't asked for any other info like the driver and that. Are they trying to take the mick? Anyhoo thanks for the above info, thats brilliant, I see another boro parker got stung by the chimps.

    Of course they are trying to take the mick, that's what PPCs do best, it's 'taking the mick' and impersonating real parking tickets that causes some victims to fall for the whole scam fake PCN racket! As long as their letters have not tried to put the ball back in your court then it's still in theirs, so sit tight and let them dig their own holes.

  • Cheers, I think the reason they're taking so long is because they totally messed up the NTK stating the reason for the PCN was due to overstaying, which simply isn't true. So they've confused themselves somewhat and are probably trying to work a way around it haha! Idiots.

    Received a reply yesterday:

    Whilst we appreciate what you have stated in your correspondence, we must advise you that the contravention code was entered incorrectly onto our system which is why your Notice To Keeper stated the vehicle was parked for longer than the permitted period. As you will see from the enclosed PCN (a copy of the one which was affixed to the vehicle), the contravention code was 'AO' and was issued as the motorist was seen leaving the premises.

    Please note that the evidence you have supplied us with is insufficient to cancel the Notice. We must advise you we have a written statement from our Parking Attendant that clearly advises us that the driver was seen leaving the site. This statement is legally admissable as evidence in court should this matter go that far. As such, the vehicle was parked in contravention of the Terms and Conditions.

    The following options are available to yourself:

    1. If you wish to exercise your right to appeal to the 'Parking On Private Land Appeals' (POPLA) service, please notify us within 14 days and we will provide you a verification code alongside relevant forms.

    2. Pay the PCN at the reduced rate of £60.00. Payments can be made blah blah blah.........

    Well, I certainly won't be taking the second option. I shall be writing back to them today to take option 1 and thanks to the good folks at this here forum, win.
