  • Thanks Umkomaas, I kinda suspected that was the case but thought I'd ask anyway. Think I've been bitten by the "bring down the PPCs!" bug :D

Stick around, get more knowledge by reading the threads here (and Pepipoo and CAG), then help out in advising others.

It's what I did a few months back, and I've never had a parking charge (avoidance strategy!) - I was just helping someone else (successfully) challenge their ticket! And I'm still here, gets quite addictive. :rotfl:
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Be warned - it becomes an obsession !!! So much so these's a risk of being banned from some websites ;)
  • Haha! I'll try and reign it in :P
  • Hi everyone

Received my NTK today. I had to laugh reading through it. They highlighted random words in bold and used "quotation marks" in random places too.

According to this letter, the reason for contravention was parked for longer than the maximum period permitted, which is incorrect.

I was thinking of basing my soft appeal on the fact that I was a customer of the leisure park and include a copy of the receipt proving this, so I can then get my POPLA code. Any advice on soft appeals would be greatly appreciated :)

    Yes.

    Dear PPC,

I am appealing against the PCN xxxxxx as the registered keeper of the vehicle xxxxxxxx. ( I am aware of the BPA Code of Practice that the keeper has right of appeal as well as the driver at the time of the alleged contravention ).

My basis for appeal is the inadequate signage at the time of the alleged contravention which I believe is in the process of change to comply with the BPA Code of Practice. As you are aware, strict compliance is a pre-requisite of BPA members.

Now I appreciate that you might take a different view as is your right. If that is the case, then I require independent adjudication which I believe is available to me through POPLA. If you do not agree to cancelling the PCN, please ensure that your rejection of this appeal is accompanied by a valid POPLA code.

I reserve the right, after further research, to add additional appeal points to my POPLA appeal.

    Yours faithfully,

    Keeper

EDIT - cross posted with Guy's Dad

Definitely include copy of the receipt, can't hurt and may just do the trick. Tell them that you are the registered keeper and that the driver on the day in question was a genuine customer (see copy receipt enclosed). Say the driver disputes the allegation that the vehicle was parked for longer than the permitted time and evidence of this will be produced at the appropriate time, but even if the situation was as claimed, the charge of £60/100 (or whatever) is in your view unreasonable and grossly disproportionate to an alleged 'offence' of overstaying a few minutes in a (free car park/car park where it costs only £1 an hour to park/whatever) and as such you believe it is an unlawful penalty and unenforceable. Then tell them to either cancel the charge of give you a POPLA code (have a search on 'soft appeals' for the way to word it).

Just as importantly - do follow this up by sending a copy of the receipt with a firm letter of complaint to the leisure park - if you can't find a name mark it 'for the personal attention of the CEO. They are often pretty good at cancelling charges for genuine customers. Have a look at Coupon's thread, there are a few retail parks and I think at least one leisure park on there, so have a read and get a feel for what you need to do as this is surely the quickest and painless way of seeing this thing off

Yes, that's a good alternative and one I would recommend for Parking Eye, but not sure about Excel.

Certainly if you do find the leisure park's adress, contact them as suggested but in parallel with your appeal to the PPC.
  • Thank you both so very much.

I have searched and searched and searched for the details of the leisure park but to no avail. If you have a look at my previous posts you can see I wrote to all of the shops regarding the invoice but no one is taking responsibility for it. I haven't had any response at all from some of them.

I will send my appeal tomorrow, thank you again :)

Middlesbrough Leisure Park, there's a phone number here, any good?

    LINKY to 192.com

Or try FPD Savills, as landowner, as suggested by these results:

    http://www.trevorwoodassociates.co.uk/press/2002/160802%20LEISURE%20FACILITIES%20BOOST%20RETAIL%20PARKS.pdf

Or try complaining to your local Councillor like this:

    http://www.thenorthernecho.co.uk/news/local/northdurham/durham/10695038._Parking_spies__hit_wandering_shoppers_with___100_fine/?action=complain&cid=12016395

...and if your Councillor is useless, ask why they are not as proactive as that guy Mark Wilkes for at least putting a piece in the local paper and making complaints, saying he will complain to a centre about notorious PPC UKCPS 'fleecing' people. Link was only last week so very current, time to rattle your own Councillor's cage then!

Your Councillor can also no doubt find out who runs the Centre and pass on your email address if nothing else, if they won't divulge the details to you. :)
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
