7 day consumer rights

My daughter purchased a mobile phone from a high street mobile phone shop, 24 mth contract via vodafone seemed fine at the time.
However within a day we all felt this was not the contract for her, using my small amount of knowledge of consumer rights we took the phone back and asked to cancel that contract and return the free phone, we were told that this could not happen, We returned home, spoke to vodafone representive and were told that what we had been told was rubbish. Returning to the shop we asked him to phone vodafone he did, then the salesman pointed out a in small print(and i mean small) that the compnay does not do issue terms of terminating the contract once signed.
I am still puzzeled, it seems that my daughters consumer rights have been taken away.
Can anyone advise or offer some kind of explination.

I'm pretty sure that there is only a statutory right to a cooling off period if the contract was signed in your home and not if it was done in the retailers place of business.
It doesn't matter that the sign in the shop was small as there is not any legal obligation for there to be a sign at all.Under current UK law you can cancel a mobile contract within the first 7 days without the need to give a reason to the provider if you have either:- Ordered online
- Ordered by phone
- Ordered by post

Why is a crazy law?
You would think that if an adult is responsible enough to go into a shop and sign up for a 2 year contract that they would also be responsible enough to actually read up on the service that would provided and the terms and conditions of that contract before signing.0 -

I have done a google search i see no mention of signing in a shop or at home, i would have thought/hoped consumer rights / 7 day cooling period is in place where ever you are.

I notice that this is refered to as iphone, so am back to the shop to argue our point.

Surely if you had the right to buy anything in a high street store, take it home, then after opening the box, taking the goods out and examining the item, decide that you didn't want it, so returned it back to the store without the box, wrapping or instructions and obtained a full refund, (as is currently your right under the DSR's) this would only lead to increased prices as there would be no way that the store could then resell the goods at the full price.
How would shops possibly having to increase their prices to cover this sort of scenario encourage more people to use the high street?0 -

Its not what what not.or indeed personal feelings.
My question relates to consumer rights and the 7 day cooling off period, do we have the rights or not, surely it applies to everyone and everything..I just made a phone call to carphone warehouse, asked them if they have a colling off period and was told yes, its 14 days, i have also phoned two other main stream shops and they all say the same, YES we do a colling off period.
Why should one shop be any different.0 -
Shops have no legal obligation to offer any "cooling off period" those that do, do it as a gesture above and beyond what the law says they have to. There is no automatic right to a refund for an unwanted item bought in a shop in the uk whether it's 7 days or 7 seconds since purchase0
