    Very unusual. I've had every model of iPhone released, some direct from Apple, some direct from networks and some via CPW and Phones 4U. Every single one has been factory sealed...

    yeah same for me too, every phone/tablet we got at work came sealed

    The network one, possibly opened by the salesman while processing the contract, possibly to put the sim in the phone.

    I have never seen (nor have friends who worked for Apple) a new iPhone in an Apple Store that did not have the plastic wrap around the box.

    Either you are mistaken, or someone decided to remove the packaging instore (I know which I would find more likely).

    How did you know the phone was used ?

    I have just sold a 2 year-old iPhone 4 on eBay. Once I had factory reset it, given it a good polish, any packed it up in it's original box, I think most folk would have been hard-pressed to tell it was used. I find it hard to believe that Vodafone can't do at least as well as me.
    If the phone was damaged, then just return it to the store for replacement. If the box was sealed, then the store had no way of knowing that the contents were damaged anyway. Damage could have occurred during factory packing or in transit.
    These things happen, take it back to the store, get a replacement, get on with life
    I try not to get too stressed out on the forum. I won't argue, i'll just leave a thread if you don't like what I say. :)

    I don't think there is anything wrong with buying somebody an iphone as a gift. Some people on forums seem really quick to judge when they know very little about you. Perhaps shes not the kind of woman who rates handbags and shoes! Either way is not that relevant here...
    Anyway, how horrible to hear about the situation. I'd have been embarassed too! I once bought my mum a tom tom satnav direct from tom toms refurbished outlet section and alas after about a month of emailing customer care back and forthe damn thing could still never get a signal or navigate anything at all! And I remember how embarassed and bad I felt about it. I had to open a dispute to get my money back as tom tom refused to let me return it and eventually I got my money back and broought her a navman instead. But Id never buy a tom tom ever again after that and I always advise others to be wary if they being them up. Terrible company from what ive seen. In any case my point is if I were you I would never go back with a company who made such a mess up out of principle. Especially one that wasnt particularly apolagetic and didnt do everything in their power to make better the issue. Half off your first bill is so very little for the inconvenience and upset...not customer service in my opinion!

    I also find it totally possible a used phone was sealed up. Electronics CAN be re-sealed you know, people! Use your brains!
    If someone buys an iphone online and opens it and returns it under the distance selling regulations you dont seriously think vodafone are gonna consider it 'used' or damaged goods do you? They are far too greedy for that. It will be re-packaged and sealed and sold on again. The tamper-resist seals count for !!!!!! all and can be easily replaced.

    despite providing evidence from apple that this handset was bought and registered by someone else ( and not me) in feb 2013, Vodafone refused to intervene.
    The person who bought this handset firsthand, had also used it in Vodafone network. That is the irony.
    Vodafone has said it has nothing to do with this deal despite the fact that it was bought from one of their showroom!

    I wish I could post some snaps on this forum.
    There are so many scratches on the backside that Even a blind person can say that it is a used phone.
    No earphones with the handset !

    Can i ask a question please? As a part of the contract papers, isn't the sellers obliged to put down the i.m.e.i. Number of the handset on contract papers? Is this not a legal requirement?
