T-Mobile Notice Period Charge after cancelling the contract under DSR

Hi all

After porting my number in to TMobile, I decided I wished to end the contract under the 7 day cooling off period and get a PAC to port my number back out again. I eventually received this PAC after about a week and a half of wrangling with them. I have now received a final bill from TMobile which includes a 'Notice Period Charge' of £11.10. Now, to my mind, because I requested cancellation of the contract under the 7 day cooling off period, TMobile can only charge me for the service between the time it began, and the time my PAC was used to port my number. The 'Notice Period Charge' appears to be based on the notion that the standard 30 days notice clause applies, which I don't believe it does when the DSR are enacted. Is this correct?

    Your DSR rights end at the point the service began. If you've used the service the you would be cancelling under their return policy instead. The terms of which they can choose (as long as they are not unfair - would be up to you to demonstrate that though)

    This is the wording on their returns/cancellation policy
    We'll refund what we owe you within 30 days of receiving your request. You'll have to pay for any usage before you return the phone to us. If that's on pay as you go, we won't refund any credit you've spent or any left on your phone when it's returned. If that's on pay monthly, your final bill will include a charge for services used at your price plan rate.

    There's no mention of a 30 day notice period being required for a cancellation under their 7 day returns policy, and the policy seems to imply that the only charges I'll receive are those at the price plane rate (line rental, text, call and data charges etc) up until the day the service is ended.

    I would imagine it's due to the fact that a pac code request has to be made available for 30 days

    If you hadn't used it the contact would still be running they are obliged to make it available for the 30 days

    Surely TMobile would know when to bill me to as they can see on their system when I used the PAC and my account ended, so they'd know to only bill me to that date?

    Just because they know when you used the pac makes no difference to the fact you asked for it to be available for 30 days

    I couldn't ask for it to be available for less than 30 days. But that doesn't explain why they've charged me for 30 days when I used the PAC within 5 days.

    Depends how you look at it ....if you gave me 30 days notice to move out of one of my flats I'd charge yo 30 days even if you moved out on day 5

    I didn't need to give TMobile 30 days notice, I was cancelling under their 7 day cooling off period clause.

    You expect them to do all this work for free? You are extremely lucky you didn't lose your number in the process as these change-of-mind shenanigans play havoc with established procedures.

    Your cooling off period is separate from number porting and brings with it additional costs. The fact these are not billed does not mean there is no cost and you would be aggrieved if the number disappeared because of your intransigence.

    I can't see anywhere in their cancellation terms and conditions where it states that number porting will come with an additional charge (in fact it makes no mention of number porting, it just says you'll pay for what you used under the price plan you picked). Sadly, TMobile's coverage checker was way out, hence the need to cancel under the 7 day cancellation period.
