They have up to 35 days...or longer if they faff about delaying things with a useless reply!

  • Hello guys

Today I received a generic reply from PE regarding my soft appeal.
The letter they sent me has no popla code.
Basically it says " in your correspondence you state that you were shopping at the site, but you will need to provide us with evidence of purchases made in the store at crown wharf .................. suitable evidence would be receipt or bank statement"

It then says my PCN is placed on hold for 14 days to enable me to provide these details.

What should I do stroma coupon mad and other experts?

    Thanks

In this case, there is a fair chance that the PPC will cancel the charge if you can prove you shopped there. Receipts, bank statements and card statements , suitably redacted, might just do the trick.

Careful about writing in the 3rd person, of course, but well worth a shot.
  • Shall I send PE prove of shopping as they have requested or demand the popla code which they have FAILED TO GIVE ME.
  • Thanks guy dad
Shall I send them proof and say " here is the receipt you asked to proof that the car was parked and used for genuine shopping at your shopping centre"

Whilst I have previously posted on the fact that PE will drop (unenforceable) charges on production of receipts/bank/credit card statements, this is a hidden element of any supposed contract that has been entered into, which I believe is an illegal practice (anyone confirm with reference for bookmarking please?).

If there is this element to the 'contract' then it should be writ-large on any signage. Whilst it is a get out of jail card on an individual basis, it should be evident to anyone reading their signage, regardless of whether they have access to the Internet, which seems to be the only other place available for advice.

Oh yes, for sure if you've got the receipt/statement to prove that. If they've asked for it, there looks a better than average chance of it being cancelled. And if they don't cancel after asking for it, and you supply it, it's going to be a killer point for you at a possible POPLA stage in the future.

The point I was making in my previous post was in relation to the bigger picture going forward.

Your covering letter should say something to the effect:

    Dear PE

    PCN Reference xxxxx

As requested in your reply to me dated xxx, please find enclosed receipt(s)/redacted bank/credit card statements as proof that I was a customer at xxx store (and yyy store and zzz store if more than one) at Crown Wharf on xxx (day) xxx (date).

As this (these) prove that I was a customer of the store(s) on the date in question, I look forward to your confirmation of the cancellation of this parking charge.

    Yours faithfully

EDIT - PS, only send photcopies/scans of receipts/statements keep, originals. AND redact (scrub out either electronically or with a marker pen) everything other than the spend at the stores on the statements, and especially bank/credit card account reference numbers.

Shall I send PE prove of shopping as they have requested or demand the popla code which they have FAILED TO GIVE ME.

At this stage, as they have asked to see proof, then a polite letter back saying something like.
"Thank you for your letter of dd/mm/yy asking for proof of me being a bona fide customer of whatever shop.

Please find enclosed a receipt to confirm this.

I would be most grateful, therefore, if you could cancel the charge or, failing that, please send me the appropriate paperwork and code to enable me to make an appeal to the independent adjudicator.

    Thanking you in anticipation,

    Yours faithfully"

It doesn't hurt to be polite at this stage as it looks like they may cancel (otherwise why ask for receipts?)

Edit:- Unkomaas got in with his letter suggestion as I was typing this. Either would probably do, but I would ask for the paperwork and code as in mine.
