Partial Refund Query & 6 year claim

Hello all,

this has been a head banging exercise

Bought a TV 43 months ago and raised a claim with the retailer under SOGA. They acknowledged that it was a manufacturers defect and would be covered. The part is no longer available and the TV is uneconomical to repair.

They then offered me £250 for a TV I paid £599 for.

They spent along time explaining how they calculate the figure based on the use I have had out of the TV and its based on the 6 years that I'm covered for

My argument is that I would expect my TV to last longer than 6 years and that it is unfair to use a legislation that is designed to protect the consumer as a measuring tool for the lifespan of a TV?

I have tried t explain to them today that I would expect a TV to last for 10 years and that we own 2 TV that are over 7 years old. SO would be willing to expect £384 but they keep on harping on about the guarantee being for 6 years!

I find it annoying that they use the '6 year' to calculate the life expectancy of an item!

Any help or advise?

    There is no specific guide as to how long goods should last. They have probably used 6 years as this is the statute of limitations under English law.

    Compared to many companies this is being generous. I doubt you'd find a retailer working on a longer basis, and I can't see a court finding otherwise either. Take the money offered.
  • Or why not see if you can find a tv with similar specs to the one you have, but i agree i would take the money as that would buy a decent tv.

    With the way most TVs are made these days I would say six years is an average to good life. I have one on the blink not going to last much longer and it's 4 years old. I paid around £400 for it and wouldn't expect it to still be covered now and would say it's had a reasonable expectancy.

    Considering the price of some TVs when I bought mine were easily into to the £1000s then I can't expect mine to be as good or last anywhere near as long.

    While £599 is a lot of money it's pocket change in respect of the value of TVs and no way it could have been a high end model at the price you paid. I would barely expect one for £2000 to last ten years so think you are really pushing the expectancy of yours if you think it should last that long.

    No electrical products are made as well as they used to be, they all use cheap parts and cheap labour to keep costs down and maximise profits, sadly that's just the way it is these days.

    A similar specifiaction TV is more than what I paid for this one. The money would never buy a 50" equivalent, its a contribution towards it

    To be fair though any 50" plasma almost four years ago is a cheap bit of kit if it only cost £599.

    Especially if you consider the model I bought at roughly the same time, it is a Samsung 40" LCD only HD ready and 50hz with no USB playback and that was £400 so for just £200 more you've had a TV 10" bigger and couldn't really be any lower spec than mine as mine was a low spec even for the time it was bought.

    The money they give is not supposed to be the full cost of a replacement. It takes into account the 4 years enjoyment you've had from the TV, they are being very generous with what they have offered.

    You won't find a similar spec 50" to four years ago, technology has moved forward so much in that time that anything you end up with will be a better TV.

    That's exactly what it is. The time you've had it is taken into consideration when calculating a partial refund.

    Its a 50" Samsung with 3 HDMI, USB, Freeview, 1080p Full HD, 20w speakers.
    They had a deal on for xmas and then they have had the same deal on similar spec TV's every year.
