Yet another PCM parking ticket - reassurance needed

    Yes keep ignoring, Newlyn's are not the creditor so its impossible for them to initiate a small claim, well unless they are utterly stupid, and they are not that, they will get bored of you once they realise you are coughing up.

    As for the parking company they haven't issued a single claim since pofa 2012 came into force, and probably never even before that.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    I have 3 from a company that enforces a local car park where I shop and after fretting like you I have researched that such tickets are unenforceable unless the actual land owner pursues you and they have you on CCTV getting out of the car with the key in your hand with your licence photo card clearly visible around your neck.

    They have about 4-5 hurdles to get over in any case to provide it was you driving let alone agreeing to their contract. They try to presume that you are aware that you are agreeing to it by putting up signs and working on the assumption that your licence plate going past a camera is your signature...

    Land with car parks are usually customer parking meaning that the land owner rents the buildings on the land for commercial use. Its not in the land owners financial interest to disrupt the businesses renting from him/her by harassing their customers and round and round we go.
    The harder one works the luckier one gets!
  • Thanks again for the reassuring words. MeadowHall haven't been in touch, and I suppose they wont as it is a free carpark. If it is strictly no parking on the hashed area's, they should turn them into raised paving area's or rope them off. The area was massive and easily accommodated my Astra.

    Look under Civil Enforcement and others for pictures of older letters they used to send. Nothing has changed and people have ignored these for many years. I have ignored 3 fake PCNs myself and kept the scary letters for a laugh and to show friends who might be feeling worried.

    Shame you missed the chance to appeal though. A decent appeal to POPLA would have kicked this into touch with no need for you to get all this junk mail.

  • son just told me he got a parking ticket from pcm northampton after he parked in a closed pub car park- he had parked there many times before without problem but there are now signs up saying dont park but he didnt see these :( His mates told him to ignore the charge today he has received another letter asking for £100 I think he should pay it as it was in the wrong what do you all suggest. Thanks for your advice. He is all for ignoring it again.

    Ignore used to be the right advice but do tell his friends that it is 'so last year!' They are clearly unaware of POPLA then? Read some threads about it. as long as the incident was in England or Wales. And...wait a minute...you actually think he should PAY a scumbag like PCM? THINK AGAIN, THAT WAS NEVER, NEVER THE CASE!

    Same advice as on every new thread here. PCM are easy-peasy to beat at POPLA. If you don't know what POPLA is you/son just need to read some threads on the forum, start at page one by clicking where my signature below tells you to click to see current threads.     Also I reckon your son should go and get some photos of the signage, what does it say, where are those signs and is there a sign at the entrance. At the entrance, take a pic or two showing the angle from a driver's window on approach - is it fully and clearly readable on entry without turning your head away from the road? It would help the forum if you could post on a new thread of course(!) details of your case and pics of the signs. You will have to break the links by removing the http:// from the front and maybe replacing the . in the URL with 'DOT' because newbies cannot post links. In your case it's important that we see the signs to judge if PCM are alleging 'trespass', or 'breach of contract' (different things when it comes to a POPLA appeal wording).

    Tell us ON A NEW THREAD PLEASE AS THIS IS SOMEONE ELSE'S THREAD!!!! once you get your POPLA code and have drafted a nice robust POPLA appeal if needed.

  • Been watching this with interest, as I am going through a similar process and looking for reassurance, got my first Newlyn letter this morning. (which I will be ignoring)
