The Protection of Freedoms Act 2012 gives keeper liability providing the parking company complies with every word of Schedule 4. None of them do up to now, which means if it ever lands up in court you must use as part of the defence all the breaches.

And pofa 2012 does not apply in Scotland or Northern Ireland at all, so no keeper liability. Can I just say that pofa 2012 is not really worth the paper it's written on, most of the time it's actually the keeper driving so it matters little. Plus they can only enforce anything if it goes to court, and if they win!

Is this true? Does it apply to the Scotland? Many thanks.

Have you actually read the thread/advice given - This has already been dealt with?

Thanks but I did read all the replies carefully and appreciate these great advices. Maybe I didn't make it clear this question is about the the change of the law in 2012, which is not discussed previously in the thread. I think it should be the Protection of Freedoms Act 2012 thing mentioned by Stroma. It is nice to know the POFA 2012 doesn't apply to Scotland. If I'm wrong please don't be hesitate to correct me. Many thanks.

you are hijacking someone else's thread here, its best to =create your own thread on this, I will ask Crabman to split what doesn't apply to the OP away from here and merge it with yours if you create one

There was no change in the law in Scotland - alluded to in posts 2, 3, 5 and 6!
