There is difficulty in 'proving' who was on 'first'.
The OP did state the van was seen approaching. [from the OP's right].
The OP will have difficulty proving the van was in fact a 'following vehicle' on the roundabout..[ie did not met the criteria for being 'given way' to?]..having been hit on the side.
The OP needs to demonstrate the van driver failed to exercise due care & attention. [what the van driver drove like, prior to the collision, only tries to set a 'tone'.....and will have little bearing on what contribution there may have been to the collision.]
I suspect the insurance outcome will not favour the OP. [failure to give way??]No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -

If it wasn't for my side airbags I would be in hospital, my A3 is a write off.

The Insurance companies follow a simple set of rules as the costs can exceed the claim, eg vehicle A collides with the rear of vehicle B , A= liable. Vehicle A crosses a solid white dividing line and collides with B, A=fault, pedestrian runs into the path of an oncoming vehicle, pedestrian =fault, pedestrian runs into the path of an oncoming vehicle, driver is breathalysed and over the limit, driver's fault, there are lots of scenarios and then to save time and resource split liability can come into effect. Circumstantial evidence may come into effect and they opt for split liability.0 -
Can you tell us the roundabout and roads was concerned to search on Google Earth?
As if it was a large roundabout, I don't understand how he could have traveled 50 yards to join the round about, plus got to the next entrance of the roundabout to collide with you in the time you enter the round about and progress forward.0 -

I was on chester road turning into holborn road, he was coming down holborn road.The van was beside the junction just before the roundabout when I saw him.Witnesses state he didnt slow down at all on his approach and had passed them on holborn road at over 40mph bipping his horn and flashing his lights.The van is quite big.

I'm not keen on that bitIs that speed prudent to be crossing a junction in a motorised vehicle? Just my question (although the insurers could ask the same, out of interest does you car or did your car have the auto stop start feature? I know on my mate's Audi, I have been cought out a couple of times by it shutting off at a roundabout and not starting up again quickly enough
