Disputed cancellation fee

I came to the end of my existing contract with Orange. I decided that I would like to stop with Orange but would like fibre optic. This was arranged over the phone. I was told that an engineer would need to call to check the suitability of my line. I agreed to this and was told I had the option of an am or pm appointment slot, I opted for the pm slot, due to the fact I work mornings.
The engineer turned up on the correct day but in the morning. When I rang to explain this I was told I would be billed for the visit until it could be established that I had indeed booked pm and not am.
I was not happy with this and told the advisor, that in that case I did not want to continue with the service. As far as I was concerned any contract that may or may not have existed had been breached by the engineer not turning up as arranged.
I also find it hard to understand how a contract could be deemed in place, if the suitability of my property had been established.
I am now being hassled for a cancellation fee.
Any advice would be welcome.:mad:
