    In the absence of anyone else commenting I'm thinking of going ahead on your advice.. Do you think I should mention my being in Scotland or just leave that if I need it later?

    I'm torn...not sure whether to make a token gesture payment or not - can see reasons both ways but like the idea of stopping the bus at the first shot!

    I've read on here about the companies monitoring so don't want to put my final draft on here just in case.

    Will give it another day or so just in case you or the other kind souls like you have further thoughts or advice.

    Hi Therese

    The facts are that the PPCs have never (yet!) been known to issue proceedings against someone in Scotland. And as far as I know your PPC has no record of court proceedings anyway. So you are at very low risk. If you choose to ignore you'll get loads of ever more threatening letters, but on today's trend, nothing will come of it.

    If you want to get this monkey off your back (and I can see why you would) then the way to do it is go for an appeal.

    I am cautious about mentioning Scotland, because the PPCs are being very aggressive at the moment - just today we heard of a new tactic (which doesn't concern you, it is a different PPC) but it illustrates the fact that we are chasing a moving target. My concern is that if you stick your head above the parapet on the Scotland thing, they may just think it's a new track to take and use you as a guinea pig.

    The £10 offer is entirely your choice. You have nothing to lose (except £10!). If they accept the case against you folds. If they don't, you haven't lost your £10. If you do send £10, write your ppn ref number and your reg number on the back of the cheque, with the words "to be cashed in full and final settlement only". Take a copy of both sides of the cheque.

    Make your decision, don't post your letter or tell us what you decide, and come back when you hear from them :-)

    I know you are trying to be reasonable, but on balance it could bite you back.

    Stick to ignore for now.

    Just interested, Guys Dad, if she makes the offer on an 'entirely without prejudice basis with no admission of liability' how it could bite her back?

    Not challenging your opinion, just curious (my brain is wired like a lawyer's, we don't always think in straight lines!)

    Also, I'm interested in your opinion on the Scotland point. Although she lives in Scotland, the parking event was in England. It means they can't use MCOL, but only because MCOL is not geared up for it, not because they cant issue in England against a Scottish defendant (tho they do have to jump through additional hoops to enforce judgement and I agree they would probably go for easier targets)

    Having said that Therese - I am happy to defer to regular posters on the 'without prejudice' offer. It's neither here nor there really, just another string.

    I am also more than happy for you to follow the 'ignore advice' - as I said, you are at very low risk.

    The Scotland thing is number of things, first and foremost Keeper liability and pofa 2012 is not enforced in Scotland, so it cannot be used in the sherrifs court. Also as they issue a fake ticket under pofa 2012 and in a different jurisdiction to the sherrifs court, I doubt if they will consider something out of area.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Thanks folks....I don't have the stomach for the ignore option ....Interested in the registered keeper comments ...I'm in Scotland but the rk is my employer...England! Does that matter??
  • I wonder if any of you can help me here..
    I got a parking charge fine in whitby on 15th july and it come through on 23rd july, id paid for my parking ticket then got that daft letter through my door, it said i entered seven minutes before purchasing my ticket then seven minutes after my two hours as up i apparently left which i know isnt true, ive shown the police about it and they said they have no legal right to take money off me too but if i ignored this letter would my address and myself get blacklisted?

    Since you have personally received a PCN, the Registered Keeper (your employer) must have already named you as the driver. In which the RK has discharged its liability.
