Identity theft by family member

hi everyone. i am just looking for some generic advice if possible.

i recently obtained a credit report for my mum as she was looking at obtaining a mortgage and was subsequently declined.

what i have established is my elder brother has had a field day in my mums name.
various pay day loans have been taken out in my mums name and paid in to his own personal account.
likewise the same with a mobile phone contract as well. collectively about £2500.

the situation is now wonga are unwilling to entertain my mums complaints until we obtain a police ref number and provide a bank statement showing that she has never had a wonga loan.

my mums concern is she doesnt want to get my brother in trouble with the police. i have washed my hands of him.

do you think if we contact the companies they can transfer the debt in to his name? he is riddled with debt hence why he has done this to my mum.

if it was up to me i would let the police go to town. its difficult for my mum to do so though. as far as we have told wonga we have no idea who it is thats done it. however we have now established it was him.

these defaults mean my mum can not get the mortgage and likewise has £2500 debt in her name which she has never seen.

any help before we contact the police would be great

Listen, if your mum did not make these applications, the people that have lost the money are the victims.

    I agree with Spacey.

Your brother has committed fraud by using your mothers details to obtain the PDL`s etc.

Your mothers credit record has now been trashed for 6 years because of his actions and unless she reports it to the Police and gets a crime number, Wonga quite rightly will refuse to do what she has asked.

Remember, they like your mother, are the victims of fraud.

I would also point out that perhaps if she does go to the Police, it will shock your brother so much that it will force him to face up to the consequences of his actions.

    Good luck.

thanks for that. i am all for telling the police to be honest if it was down to me.

do you think these companies can transfer the debts over to my brother as an alternitive?

You will catch a lot more flies on here with honey than you ever will with vinegar and some very basic manners shown to the people giving up their time to help you will bear more fruit.
If you do not understand what I said, to be honest, you are not going to be the slightest help to your mother and you will only make things much worse.

But if you dont what is to stop your brother doing this to you or another family member ?

Wonga wont do anything without a crime number because as far as they are concerned your mum took out the PDL - think of it this way - if they did what you wanted it would become common knowledge that it would be a way to avoid repaying a PDL, therefore less than honest people *may* consider that a way of avoiding repaying the loan.

The argument about whether Wonga`s systems are defective because they allow situations like this to occur , *could* be used but I wouldnt hold out much hope of it being successful.

what you said was irrelevent to my orginal post and your tryng to pass judgement on what is already a difficult situation.
your opinion on how i will impact the situation is laughable as you have no idea what my background is.
if you notice i also thanked the second person to respond so feel free not to comment if its not constructive.

Why would they? Even if they were minded to do so, it would need your brother to agree and for him to be an acceptable risk to them. Given that he clearly has an abysmal credit rating and can't afford loans in his own name, the chances of either your brother or Wonga agreeing to it are infinitesimally small.
Your mum won't see her money again unless she reports it as fraud. However difficult that might be for her.
All shall be well, and all shall be well, and all manner of things shall be well.

Pedant alert - it's could have, not could of.

I don't know why you are giving off such attitude, because people are not saying what you wish.

In the case of identity theft, ANY company will require the fraud reporting before removing it.

Even without fraud, you can't just transfer debt between people.

What you're asking, can't be done. If she reports the fraud, they'll remove it.
