PayPal dispute response deadline

Hi all
I've been asked to move my thread to this sections as there are PayPal experts here. I will point out thou, my purchase was made through PayPal but had nothing to do with eBay.
I recently opened a PayPal dispute (discussed in another thread) after a bit of a stupid quick decision.
Anyway,I originally opened a dispute on 15/07/13 as I had not received my order and no communication from the company.
However, I received the item a few days later, nothing like described, so I changed my dispute to "not as described" on the 21/07/13.
I am still "awaiting other party's response". But when you hover over that status, it says "the seller has 10 days to respond or PayPal will close the dispute and return funds to rightful owner".
My question is, when does their 10 day deadline start from? Would it be from when I first opened my dispute for item not received, or from when I changed my dispute to item not as described?
Thanks for any advice
P.s. someone just mentioned to me that changing a dispute with PayPal can often confuse them. However, I first opened it due to non-receipt of item & no communication, then changed it when I did receive it as it was nothing like described. Don't understand how that can be confusing?

Does ANYONE have any idea when their dispute deadline would start from? I'm presuming from when I changed the dispute to 'item not as described'.
If they don't respond by the 10 day deadline, what are the chances of my money being refunded? Am I likely to hear back from PayPal saying although they have sided with me, they cannot retrieve my money?0 -

Yes - that's the date you started a new dispute. The previous case resolved itself as you item arrived. If they don't respond by the 10 day deadline, what are the chances of my money being refunded? You may have to return the item.0 -
Thanks for the reply campdave. I have read this before, which is a bit gutting as that is what this company relies on: people backing down from returning item as the item is too expensive to return to Hong Kong. But if it gets me even some of my money back, then I guess it's worth it.
Will they still require me to return it even if the company doesn't respond to PayPal by the 10 day deadline?0 -
Does anyone know if PayPal will still require me to return it even if the company doesn't respond to PayPal by the 10 day deadline?
Seems ludicrous to expect me to return an item to HK at my expense after being duped out of my money by them and receiving an item nothing like what I ordered. And when the company hasn't met PayPal's rules regarding responding to them in time0 -

Have you escalated the dispute?
All the dispute allows for in this case, is for Paypal to rule that you have the right to return the item.
You should win the dispute. Then Paypal will tell you to return the item, via a tracked method. This will be at your cost.
Once you upload the tracking and it shows online as delivered, attempted delivery or refusal, your funds will be released and the dispute will close.0 -
Thanks theonlywayisup.
Yeah I've escalated the dispute. But their havnt replied to PayPal or me at any stage of my dispute.
I thought that to be the case. My only concern is that once I return the item and provide proof, PayPal will say they cannot retrieve my finds. I keep reading that has happened to people.
So I don't want to shell out even more money to return the item, only to hear PayPal say they can't retrieve my funds.
Is there any way of getting a guarantee from PayPal that if I provide proof of return, I will DEFINATELY get refunded for the item?

Well interestingly the seller has disagreed with my dispute. And as my dispute was that the item was not as described, I'm guessing they're claiming it was as described. So PayPal are now deciding on the case.
So I called PayPal and told them I can provide photographic proof of it not being as described, by sending a link to the wig I ordered, along with a copy of my order and a photo of the wig I received.
PayPal REFUSED, stating it would not be evidence as it could be photoshopped!!! Even though if they accepted my evidence in addition to any evidence the seller could ever conjure up, it would be definitive proof of who is lying.
I'm so frustrated and NOT so hopeful of getting that refund after all
P.s. What can I do to report PayPal for continuing to allow this company to use PayPal's services, when they are fraudulent?0 -

Thankfully you were right. PayPal are going to give me a full refund, but I have to pay the return costs.
Only problem is, it's all over the Internet that this company gives fake China addresses, or rejects the parcels their end.
Do I have any argument with PayPal that they are giving fake addresses, therefore costing people return costs for no reason?
Where can I look to check if the China address they have issued even exists? Or is legitimately them and not another company who's address they are using?0
