Laptop failed just out of warranty - rights under soga?

Afraid I can't access the specific code details from that link. Not sure if it's because I'm viewing it on my kindle fire. I initially filled out a contact form on one of the fujitsu pages giving them the code. That is when they said it was likely hardware and gave me the premium rate number if i wanted them to do anything. Also gave me a 01 number for parts which is where I got the quote for a replacement hdd just for a rough idea of where their prices sat really.0

Sigh... just had a reply from dabs.
"Thank you for contacting us.
I am very sorry we are unable to accept a return on an item that is no longer in warranty.
I would advise referring to the manufacturer who may be able to offer a repair for you.
Regards"
I'm pretty cross tbh that they seem to be completely denying any responsibilities under SOGA.
Is it ok for me to continue to communicate via email with them or is it better to use recorded mail? I think I am going to write quoting SOGA and giving them a 10 day timescale to suggest remedy.
Any thoughts?0 -
Load up an operating system to an external HD, change the bios to select it as boot up device and see if it runs. This will take the internal HDD out the equation, HDD failure is a common fault.0
-
Good idea! Would it work to just disconnect the hard drive and see if it will then boot from CD? I have an external hard drive but there is no operating system on it and I have no other computer available.0

As it currently stands, Dabs don't have any responsibilities towards remedying the problem.
You will need to get proof that the fault is due to a manufacturing defect and not misuse, and only then is it worth writing to them looking for a SOGA solution.0 -
But how do I get that proof? Independent inspection?0

That's right.
Get your local repairman to write a report stating what the fault is, and the fact that it is inherent.
An inherent fault is one that was present at the time of sale but not necessarily apparent at that time.0 -

If you do this (cost - perhaps £25) and you are proved correct - make sure that you claim this additional cost back from DABS too..
Your alternative is to buy yourself a new HDD (about £40) - fit it yourself (an easy job) and write the even off as being "just one of those things" !!
Novatech offer 500Gb 2.5" drive for £40.99 inc vat...
Sorry that Dabs let you down - they used to be better than that...0 -
I'll try and test the hard drive myself. If it is that I can replace it and then try to get proof and reimbursement from dabs. Otherwise I may try a letter to get them to at least engage with me. I realise the burden of proof has switched but I had hoped they would at least offer to look at it, or ask me to get it independently checked etc.
To be honest this could not have come at a worse time for us as our income has dropped a lot in the last year so my options for how to deal with it are limited. I certainly can't afford a new laptop0 -
you haven't said what the symtoms are.
you switch it on .. and .. what happens
when you boot from a linux cd, what happens.
what happens with windows recovery, and all the F8 options
if it really is a hardware problem, the machine hasn't lasted a reasonable amount of time, and therefore soga them, politely.!!
