    No the law doesn't define congested, but it's not difficult to work out. If a motorway is busy in all lanes, and lane one is moving slightly faster than lane two, then it is fine to continue at the pace of the rest of the traffic in lane one. The occasion when I think you would struggle in court would be if it was obvious that you were changing lanes into lane one just because there was a gap where you could undertake, and then you moved back into lane two.


    Surely it would be better if you just complied with the Highway Code?

    And you knowledge of the law comes from?

    No, someone who argues with each post just for the sake of it, and doesn't know the facts themselves. In other words you!!!

    The occasion when I think you would struggle in court would be if it was obvious that you were changing lanes into lane one just because there was a gap where you could undertake, and then you moved back into lane two.
    Since I had been in Lane 1 for at least 5 miles - I think I'm OK in court.

    I do (or I try to) - that's why I was in Lane 1:D

    I think there's 2 cases here.

    A) Speeding along in Lane N, come up behind a slower vehicle and then move to Lane N-1 to go around them, instead of Lane N+1. That's undertaking. Absolutely right, that is almost certainly driving without due care and attention and should be prosecuted or on the spot ticketed if caught.

    B) Cruising at a steady legal speed in Lane 1 and overhauling a slower vehicle which is incorrectly in Lane 2. Continuing at that speed and passing on the left while watching out for the other vehicle suddenly realising their mistake. Being able to continue in Lane 1 for a significant time before reaching any other slower vehicle. That's what I sometimes do. If observed by police; I have a defence that I took due care and attention because the other driver wasn't. Maybe we need another term for this...
    I need to think of something new here...

    If you are in lane 1, and the slower moving vehicle is wrongly in lane 2, then you should move out to lane 2, and then they should move into lane 1. If they don't move into lane 1, then they are lane hogging, and can also get nicked.

    2 wrongs don't make a right.

    You can't be recommending tailgating can you:eek:

    If they haven't noticed the big empty space on the left OR the faster vehicle approaching they are not likely to notice a vehicle directly behind them unless it is dangerously close.

    Mind you, there are people out there who don't notice the faster vehicle when it is a bright yellow van with blue flashing lights on the roof...

    No, why would you think I was recommending tailgating? You follow at a safe distance.

    Yes there are some drivers out there who seem to be oblivious to anyone else on the road. And they would be driving without due care and attention to other road users. But that doesn't give you the right to undertake them.

    As for emergency vehicles, I know what you mean, as I come across these drivers all the time. But I find that a blast on the bull horn tends to wake them up in most cases. :D
