Given that it was 11pm, a headlight flash could well be missed by an oblivious idiot, unless repeatedly or at close range, in which case it could be taken as intimidation. If there wasn't a constant stream of traffic in all lanes, that were moving at similar speeds. Then you DID undertake, and you are bang to rights.

Because you keep changing your version of events.
So you are now saying that you were in a line of traffic in lane 1, that was moving slightly faster than a line of traffic in lane 2, so you were actually passing a long line of moving traffic in lane 2 as part of a line of traffic in lane 1???
If this is the case, then this is legal. But that's not what you described previously.0 -

Do any cars travel below 70mph on the motorway? If they do, they don't live in Lancashire or Cumbria! I was recently travelling north on the M6 through those two counties. In the left lane, behind a truck doing 73mph. I matched his speed. Every single car on the motorway was travelling faster than me. Never mind the ones in the middle lane overtaking me. In the outside lane was another set of cars overtaking them!0

I sat on the motorway at 70mph on my way to get the Eurotunnel a few weeks back (I was seriously low on fuel), and was amazed at how fast most motorists actually drive.
Something I obviously don't notice normally

Around here when we go on the M1 it's really unpredictable. When we're on it, we set cruise control to 70 and some days the traffic will be light and crawling, have to keep checking the speedo that we're not doing over 90, other days our 70mph feels like 20 and everyone is racing around 90-100!0 -

If you were travelling at around 70mph, then you wouldn't see many other cars which were travelling at the same, or similar speed. This is because you either wouldn't catch up with them, or it would take a long time to do so.0 -

But he didn't ask if they travelled at 70. He asked if any travelled below 70.
If they are travelling below 70 you should be catching them and overtaking them.
And, anyway, a motorway always has good forward visibility in normal weather so you should be able to see some way ahead and register vehicles that are travelling at a similar speed to yourself.There are two types of people in the world: Those that can extrapolate information.0
