    No, I was going to completely ignore the charge after reading some of the older posts but it seems things have now changed and you are supposed to reply as they can now take you to court.

    It is. But unlike other people on here you were trespassing and therefore they could not offer you a contract. I saw that after you posted the photo.

    Ok thank GD. I am about to start writing the letter, I am going to assume that I shouldn't mention specifically that the the contract is not valid as I was trespassing, but I should just mention inadequate signage argument as seen on the templates provided on this forum.

    Don't mention trespass and add at the end that you reserve the right, after further research, to add other points that may emerge to any POPLA Appeal.

    The driver wishes to appeal on the basis that you do not have the authority of the landowner to levy these charges. The driver requires you to supply me with a copy of the relevant sections of the contract that you are working under in order for me to check (a) the contract is, in fact, with the landowner whose details have been supplied to me by the council and (b) in order for me to check the limit of your authority to levy charges as some landowner contracts do not, in fact, grant that authority. If you are unwilling to provide me with this, then I require, in accordance with the BPA and POFA regulations, a POPLA code in order for me to take my appeal to POPLA.

    In addition, after checking thoroughly with your signage and the BPA guidelines, The driver believes that they are deficient and this is a further reason why I require a POPLA code. I refer you to the POPLA web site for the required timescales for a response.

    If, on the other hand, after consideration, you decide to cancel the charge, please feel free so to do".

    The driver reserves the right, after further research, to add other points that may emerge to any POPLA Appeal.

    You should really be telling them to cancel the charge first, and if they don't then they must provide POPLA information. You are presenting it the other way round.

    Yep, why not word it a bit like that, it's not overly important as long as you don't name the driver! You are really only after a POPLA code.

    Once sent, start reading examples of strong POPLA appeals on here and on pepipoo. Just browsing the threads updated this week will find you loads of example POPLA appeals on both forums!

    Coupon, Slithy et al

    When this comes to the POPLA stage, it needs to be appealed not based around contract and damages, but trespass.

    The notice effectively says that Danny had no right to be there as he was not shopping at Boots.

    Clearly, this will need to be a different (and interesting) variation on our appeals.

    As I am likely to be on holiday when this returns, can you keep this in mind?
