So would my defence to both parkingeye and poplaa be sending a letter asking for proof of proprietary interest in the land, stating that the charge is disproportionate, and that the signage is inadequate?

Also would it help to post a picture of the sign in question up on the forum to get a better idea?

Don't put too much effort into the Parking Eye appeal - just say you do not recognise their authority to issue the charge. Whatever you put they will reject it so why waste time with detail ?

POPLA is a whole different ball game and one you should get guidance for from this forum. The points you've mentioned will be some of the points you would use at POPLA but with even more to add some extra clout.

Does anyone have a link for the best and most up to date template letter to send to poplaa after I send out the first pointless letter to parkingeye?

Wait on!!! lots of time for PE to screw things up, including not giving you a POPLA code.

When you get the reply to your appeal, come back and we can help.

But, Danny, try to answer the questions asked instead of jumping around like a box of frogs.

So, get the wording of the sign, please.

Thanks, I will try and be more specific from now on.

On the below link is a picture of the signage at the boots carpark.

I can't post links so you need to add http:// at the beginning of the following URL.

That seems pretty clear and unfortunately says "Customer Only when shopping in store". For your soft appeal, at this stage I would drop the signage appeal point.

Ok, is this a car park within a car park as there seems to be quite a lot of parking spaces there? (We have that in Milton Keynes where a section of a paid area is free for Argos & ToysRUs, but with 2 hour limit. Unfortunately for them, there is no sign at one of the entrance points from the other area into theirs)

In the small writing, does it explain what you have to do to avoid a charge? In fact, what do you have to do? Notify Boots in store?

Certainly there is no limit on parking time.

So, get the soft appeal in and wait for the POPLA code

Edit:- I wonder if this is not a contract case but a trespass one? On the face of it, you could not enter a contract with them as you had no right to be there as you were not shopping in Boots. It seems clear to me that you were trespassing.

Views of others and any advice about changing appeal to reflect this?

As you turn right from the off the main road you enter this little one way road. straight away you will see 2 enclosed carparks, the boots one to your left and the KFC one directly opposite to your right and straight ahead past the bend is the KFC drive thru followed by the exit to another road. Both have about 15 -20 parking spaces I think.

Your right the signage seems to be quite clear although they have changed the signs very recently after the parking charge was issued as I went there quite a few times previously and remember seeing a limit of 1hr 30min clearly displayed on the sign which is why I would always make sure to leave before that time.

Not sure how relevant that is now and how would I be able to prove it.

So just to confirm, should I just write the same letter to parking eye as I would to poplaa just with much less detail?

Just a soft appeal based upon my words in post #9 for now, incorporated into a normal soft appeal scattered throughout this forum.

The keeper denies entering into any contract with Parking Eye and is appealing against this charge as the wording on the Notice to Keeper is incomprehensible. This is a car park and clearly no vehicle that parked there could comply with the wording on your NTK.

Having read your signs again, I am of the opinion that they fail to comply with the BPA code of practice and, therefore, the Keeper is unable to agree that he or the driver owe you anything.

If you are unwilling to cancel the charge, please provide a POPLA code in order that the keeper can appeal to POPLA. This should be provided within 35 days.

Thanks GD but I thought you said that I shouldn't use the signage as part of my appeal as it was clearly displayed and worded?
