I read on here (and I have no reason to believe people are lying) that the referral for 'not actively seeking work' is automatic and you don't get your chance to have a say. In fact there is a thread running at the moment that a claimant can't even get the information out of the JC what jobs they were suppose to apply for yet alone get a chance to say why they didn't.
No its wrong, I'm a linked advisor so do them daily. ASE refferal templates have the following questions for the customer to answer.
what steps did you take during the period on what dates
what jobs did you apply for during the period..details
did anything prevent you from looking for work
what were you doing in the previous 2 weeks.0 -

I wouldn't think of it as an adviser/DM being 'more nasty' I just don't know what they would view as 'reasonable' especially if it was on the cusp as you put it.0

Those do sound fair and reasonable. When doing this does the adviser tell you the job(s) they thought you should have applied for so you get to answer the questions regarding the jobs you are being refer to sanction for not applying for?0 -

I have no idea what the ASE referral is however. We’ve had to remove your signature. Please check the Forum Rules if you’re unsure why it’s been removed and, if still unsure, email forumteam@moneysavingexpert.com0 -

No because it wouldn't be on that basis alone these are the questions we answer (may not be the exact wording)
does customer have a jsag or cc
Referring to the jsag/cc why do you feel the customer has not made their best efforts to find employment?
how many steps has customer agreed too.
how many steps has customer actually taken.
were there any jobs during the period that cust could have applied for( etc 3 on ujm, 4 on indeed exact jobs not required)
is customer a wp participant... if yes
has customer engaged with wp during the period
did anything wp ask customer to do restrict on j/s0 -
Claimant commitments are being rolled out, they will eventually replace the jsags

some info here.
Will probably be as successful as Universal Jobmatch, which Iain Duncan Smith said would revolutionise jobseeking.

Just in time for the next election.
