    Yes but will a court hear something that's not within their jurisdiction either? This happened in England so outside their sphere of influence. And does the same law of contract apply in Scotland ?

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    It's Catch 22. An English court has no jurisdiction over a resident of Scotland. A Scottish court has no jurisdiction over an alleged contract entered into in England under English law.

    But a CCJ by default is just as damaging either side of the border.

    If nigel is correct in describing this Catch 22, how could anyone get a CCJ?

    Exactly! There are actually procedures for serving papers where the defendant lives in another EU state (or Scotland or NI) but not using MCOL or the Northampton Bulk Processing Centre. There is also the problem that even if judgement is obtained that it will be impossible to enforce that judgement in another country.

    Throws up one interesting point though. When a RK gets a NTK, if the PPC was notified that the actual driver lived north of the Border ....................

    There are no ccjs in Scotland , they are called Decrees

    It's the same conundrum faced by the PPC when the driver's address is outside the UK.
