Yes but will a court hear something that's not within their jurisdiction either? This happened in England so outside their sphere of influence. And does the same law of contract apply in Scotland ?

They probably won't do a court-case involving a service station, can you imagine the uproar?

It's Catch 22. An English court has no jurisdiction over a resident of Scotland. A Scottish court has no jurisdiction over an alleged contract entered into in England under English law.Yes but will a court hear something that's not within their jurisdiction either? If nigel is correct in describing this Catch 22, how could anyone get a CCJ?Je suis Charlie.0

Exactly! There are actually procedures for serving papers where the defendant lives in another EU state (or Scotland or NI) but not using MCOL or the Northampton Bulk Processing Centre. There is also the problem that even if judgement is obtained that it will be impossible to enforce that judgement in another country. If nigel is correct in describing this Catch 22, how could anyone get a CCJ?0 -
Exactly! MCOL won't even let you try & register a claim where the address of the defendant is in Scotland.
Thanks. Didn't know that, so no danger of CCJ.
Throws up one interesting point though. When a RK gets a NTK, if the PPC was notified that the actual driver lived north of the Border ....................0 -

It's the same conundrum faced by the PPC when the driver's address is outside the UK.Thanks. Didn't know that, so no danger of CCJ.
