Perking Eye charge notice

Hi, I have just received a notice from parking eye. Friends and older threads advise to ignore it, more recent threads say appeal - I'm confused and worried. I have never been chased for money before and am unsure what to do next. Please can you offer me any advise?
I apologise for my miss spelling in the title line, it should read Parking Eye

    Current advice is to go appeal and go through POPLA, if in England.

    So, a few more details

    Date of contravention
    Brief description of what they claim you did wrong - give us some details without revealing who you are
    Date of receipt of their Notice to Keeper


    In meantime, also read up the first page of posts on this forum and build up your "information database" so you are ahead of the game when you get responses on here.
  • date of contravention = 12/7/13
    claim i overstayed in the carpark by 36 minutes longer than the stay authorised or without authorisation. It notifies me that under paragraph 9(2)B of schedule 4 of the protection of freedoms act 2012 that the driver of the vehicle is required to pay the parking charge in full.
    date issued = 16-7-13
    I have no receipts as I didn't buy anything from the shops on the retail park, I was just browsing and lost track of time. I spoke to a store employee when I realised I'd overstayed and they said they couldn't help and I'd have to pay up.

    Send a soft appeal to ParkingLies, lots of examples on this forum, doesn't really matter what it says 'cos they'll reject it anyway. The crucial thing is not to mention who was driving, write in the third person as "The Keeper". Look around, you'll see how to do it.

    When they reject it they will send you a code for appealing to PoPLA. In the meantime read the forum and look for PoPLA appeals so you've got some idea what to write. We'll help you when the time comes, DO NOT DO IT ON YOUR OWN, as you might miss the crucial points that always win.

    They are dressing up their fake charge pretending that it's somehow official & sanctioned by law. What Schedule 4 of POFA 2012 actually states is that to be a valid Notice To Keeper it must contain certain information (see below). What POFA 2012 does not do is require the driver to pay the parking charge.
    9 (1) A notice which is to be relied on as a notice to
    keeper for the purposes of paragraph 6(1)(b) is given
    in accordance with this paragraph if the following
    requirements are met.
    (2) The notice must
    (b) inform the keeper that the driver is required to
    pay parking charges in respect of the specified
    period of parking and that the parking charges
    have not been paid in full;

    Hi I posted here October last year, cant find the original thread. I got a letter from Parking Eye asking for £85 payment for being 4 mins late. I emailed them to appeal to say I was heavily pregnant at the time and after finding a toilet for the umpteenth time that day and waddling back to my car with a toddler in tow I was inadvertently 4 mins late! They rejected my appeal so I ignored any further letters. I have now received by recorded delivery the threat of courts if I do not pay in 14 days. Can the enforce this? Worried now as with young family I cant afford legal fees never mind £85. Any advice very welcome thankyou.

    If you can't find your old thread please start a new one, don't just hijack someone else's, particularly since you are going to need quite detailed advice.

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    You only have to click on your username and there is your PE thread from 2012! Add to that thread with a reply now and make it clear, is this a Letter before Action? Please post the answer in your own thread not here.
