    Your starting point is in the sticky at the top of the forum index page 'POPLA Decisions'. Read through the most recent - say last month or so. These are all winning POPLA appeals.

    Have a go at drafting your appeal, then come back to us with a copy and we'll help you to fine tune it to give you your best chance of success.

    Points to bear in mind:

    * mitigation (telling your story - no matter how good) won't do it for you.
    * concentrate your appeal around pre-estimate of losses, signage, contract with principal and lack of proprietary rights - they're the 'winners' at the moment.
    * copy and paste others' points about the above, but then try to smarten them up into your own style and to suit the particular circumstances surrounding your parking incident.
    * don't lose sight of the POPLA deadline for submission - miss that and there's no second chance.

  • ok here goes The Basic Draft of My Popla appeal :-

    a) The parking charge is unenforceable as it is punitive and has no relation to any loss The Landowner Has suffered.

    b) according to the BPA Code Of Conduct Version 3 June 2013 18.2 "entrance signs play an important part in establishing a
    parking contract and deterring trespassers. Therefore,
    as well as the signs you must have telling drivers about
    the terms and conditions for parking, you must also have
    a standard form of entrance sign at the entrance to the
    parking area. Entrance signs must tell drivers that the car
    park is managed and that there are terms and conditions
    they must be aware of"
    There Are No Visable Signs At The Entrance As The Enclosed Photographs Show.

    Do a decent draft and then come back.

    You've missed a number of the key winning points I gave to you in my advice in post #22.

    As well as Guy's Dad's links I suggest you revisit #22 and carefully go through the winning points in it, then look for those in the POPLA Decisions sticky and you should find the form of words to wrap these up in.
