    hello I have been away on business for 10 days however I have drafted a reply. any thoughts would be welcome.


    DearSir/Madam,


    Your charge is unjustified and punitive and my next step will be tocomplain to your client. I can advise you that the reason the car wasparked in this way as the car that was parked in the next bay hadparked so far to the right of the bay The passenger who was heavilypregnant was unable

    toopen the door to leave the car. The car was parked for approx 45minwile the passenger went to mothercare.

    As stated above thepassenger on the day was heavily pregnant. Not only is the passengermore slow-moving than normal at the time, but in this hot weather sherequired a period of rest to drink during this shopping trip.

    Iam aware from my research after receiving your fake PCN that, in somecar parks, Allow double time for disabled visitors in an attempt toconsider the effects of the Equality Act 2010. A pregnant lady,whilst not being disabled of course, is protected under the Maternityprovisions in that Act these are provisions which apply to serviceuser (customer) situations as well as in employment.

    I amsure you and your clients in this Retail Park are aware that it wouldbe unlawful to treat such a visitor unfavourably by virtue of hercondition. This instance as is allowed for people without such'protected characteristics' would be a breach of the Act. This iswhere a business model using wardens, such as yours, completely failsto provide any parking management whatsoever and alienates genuinecustomers - and retailers in the long run.

    If you will notcancel your fake PCN I will of course require a POPLA code andreserve the right to raise additional points of appeal at that stage,as well as complaining to your client, the Retail Park Management andthe landowner and the Store Managers too so they are alerted to thereason why the family are minded not to return if this is how genuinecustomers are treated.

    another thing I wanted to ask the signs that are dotted around the car park, you cant read them when you enter the car park, you can only read them when you are leaving the shops and walking back to your parked car

    Yep that will do nicely.

    And yep, if you read the Appendix about 'entrance signage' on the current BPA Code of Practice (which these companies have to adhere to) you will see that signs have to be fully visible to a driver on arrival. Find the current (June 2013) BPA Code of Practice on the British Parking Association's website - it's not too long so can be skim-read through to the relevant Appendix.

    I would add a sentence about their BPA Code of Practice non-compliance as far as entrance signs are concerned, into the middle of your letter.

    And if you have a receipt or proof of purchase from that day then attach a copy of it because the PPC might well ask for it and delay matters otherwise, so send it up front if you have it. Don't call it 'my receipt' of course as you want to avoid anything that implies who was driving. You could call it 'the passenger's receipt' or if there is no proof of purchase, just say 'whilst no purchases were made that day beyond some water and a snack, the passenger was in fact browsing in Mothercare with a view to returning to make some fairly expensive baby-related purchases in the near future but is now minded never to return unless you cancel this fake PCN.'
