I have contacted the BPA and they have replied -
We have contacted the operator in regards to your complaint and can advise that the letter you received was dated the xxxxxxxxx 2013. This would have been the 14th day in which the operator had to send this out. We appreciate you did not receive this until 2 days after, therefore if you wish to pursue this, we would suggest you contact the DVLA to confirm when they released the keeper details. If they released the keeper details with enough time for the operator to send the letter before the Date xxxxxx 2013, then please contact us further.
We would suggest you re-send your appeal including all the reasons why you dispute the charge (not just the perceived late notice to keeper) to the correct address. Once the appeal has been received, the operator will be able to consider it and if necessary provide you with details on how to appeal to POPLA.
In view of the above, we have closed the investigation.
Thank you for bringing this matter to our attention.
To be honest I dont feel they were on my side and they seem to have not had APCOA on the 14 day rule ,which was our only point of appeal at this point as advised and we believed is valid as the rules state their is a strict 14 day timescale for any PIN to be delivered to me and clearly this was not met, although we advised there are others.
What is the plan of action?0 -
I would do exactly as they suggest because they've said they WILL investigate further if you can show that the DVLA gave them the data in goodtime, and they have said that if you appeal now the operator WILL consider it and give details of POPLA. So play the game!
So an email to [EMAIL="FOI@dvla.gsi..gov.uk"]FOI@dvla.gsi..gov.uk[/EMAIL] making I clear you are NOT asking for data, do NOT need to fill in a V888 and are simply asking 'when did APCOA get the data of MY car, because the BPA have asked me to ask you...not sure why they couldn't have done so themselves at one of your cosy meetings trying to justify the actions of PPC rebels without a 'reasonable cause' but hey ho, please tell me when you released MY car details of registered keeper to APCOA?'
And send a challenge to APCOA, nice and strong and saying the BPA told you to write and that APCOA would have to consider it and give you a POPLA code...but you'd be just as happy if APCOA just cancel it because clearly they are going to lose at POPLA.

Yes but what if the DVLA did not give them the data in good time ,does that effect me ,because am I not supposed to receive any PIN within 14 days. Say the DVLA did not supply deatails untill the day they sent it?

Thanks for all the help and advice ,ticket cancelled due to late issue, a word of warning though I am not convinced the BPA were entirely on the side of Not Guilty during this dispute, I found their attitude to be lazy in acting and they needed to be reminded of their responsibilty before they informed APCOA of their need to follow the rule book in my case.0

That's what the BPA Ltd always do. Don't forget that they are a trade body and not a regulator and are funded by the PPC "industry". If you are familiar with Terry Pratchet they are the equivalent of the Thieves Guild.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

They were entirely NOT on the side of Not Guilty, never were, never are, never will be. They're far too busy driving up standards in the car parking industry.
Nevertheless - good result :TPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
