OK chaps I think I have got APCOA !!!

Options
On the 14 day rule for a camera based (no ticket) PCN .

My PCN was only issued 15 days after the day on which the offence was allegedly commited so I am having them for that and hopefully the charge will be cancelled. Should I just leave it at that or do you guys want me to do anyhthing else. I am sending the letter copied from this forum advising them of their error and asking for a POPLA code as advised.

Many thanks for all the advice .

Good spot, not like APCOA. Could complain to BPA and DVLA, not that it'll get you anywhere.

Well if you want to drag them to POPLA and make them cough up £27 (and why not?) then keep your powder dry, you don't want them to know you've got them by the short-and-curlies so they cancel it, you need to lead them on. So send them some utterly wet appeal (you were only there for a few minutes, you don't understand why you have to pay, it's so unfair, some rot like that) and then come back for help writing a blockbuster POPLA appeal after they've sent you a POPLA code.

Dunno if you can email your appeal to them, what does it say on the Notice you received? If there's an email address I guess you can, but does it say that, or is the address something like "appeals@..."?

Yes I think I will do that ,so in future they will examine other peoples appeals more thoroughly cancelling them if there is good reason, knowing that if they press on they can be stung for £27 by victims in the know .

    Good luck all . :beer::beer:

Not too wet. Some are being difficult about issuing POPLA codes citing that there was no genuine appeal.

So pick something like "I contend that the signage did not meet the minimum requirements of the BPA guidelines and that the charges do not represent a true pre-estimate of loss".

In your case, you want a POPLA code and to cost them £27.50 and you have a 100% get out of jail free card, so you have to give them a real bait to bite on.

Well ignore roxburghe completely. And get your complaints into the bpa, dvla, trading standards, watchdog, local press, oh and don't forget to get the retailer as well. Tell them that they have unlawfully got your registered keeper details out of time, and they are in contravention of schedule 4 of the protection of freedoms act 2012

BPA and DVLA email addresses to make complaints to here:

    https://forums.moneysavingexpert.com/discussion/comment/62837083#Comment_62837083

And you will notice that was a complaint about a late Notice to Keeper...just like yours! Also am I right that APCOA don't even call it a Notice to Keeper but include the misleading word 'Owner' as well? Another breach...there may be more, check here:

    http://www.parkingcowboys.co.uk/keeper-liability/

And if this was at an Airport or Railway station (?)...well...there is also the 'small matter' of APCOA sending misleading letters mentioning POFA and trumpeting about 'keeper liability' for an incident on land where it's generally true that bylaws take precedence and neither POFA nor rk liability apply at all!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I too have an appeal in with APCOA, which I sent about 4 weeks ago. Not had any reply yet or any other correspondence from them.

Is it 35 days they must reply in or invoice is cancelled?
