I too have an appeal in with APCOA, which I sent about 4 weeks ago. Not had any reply yet or any other correspondence from them.
Is it 35 days they must reply in or invoice is cancelled?0 -
Received another letter from gpb soilicitors asking for an increased fee and saying I should contact Roxburghe , if I fail to do so I may be taken to court where I could face a judgement being placed on my record and this will affect my credit rating.
APCOA still have not even notified me that they have received my appeal ,shall I ignore the letter from gbp?

Have you sent in your complaints to the list given above?
If you want to stop the tirade of threatograms coming your way you must get that POPLA code. Get back on to APCOA.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I'm sure you would.
But do not ignore any court papers that come your way, get back and see if our advice might be more helpful then! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Never underestimate the administrative shambles and lack of adherence to POFA and BPA CoP that these companies and solicitors/debt collectors suffer from.
Your original post indicates that they have not followed the strict requirements of POFA so they can not pursue you as keeper and as long as your "get lost" appeal didn't admit that, then you don't need to supply driver details.
However, being cautious, I would re-send your challenge saying that this is what you sent before and they should call off RoxyMusic and cancel the charge or formal complaint to BPA/DVLA will ensue.
I am with Unkomaas on killing things before any court case possibility.0 -
I got a letter from Roxburghe last Saturday chasing for money and then I got a letter from APCOA during the week saying my appeal was successful...0

That's great news! Well done!
But still report them to BPA and DVLA as suggested earlier because:
1 They unlawfully obtained your details from DVLA; and
2 They unlawfully continued to pursue you for the money while an appeal was ongoing, in breach of the BPA CoP which they are signed up to.
They will only be sanctioned for breaching their obligations if people complain about their conduct.

Great news about the appeal being successful. I've only had total stonewalling from APCOA, but this thread was great to tell me that their non-communication is actually in my favour.0

This thread is starting to give the impression that it's closed because of Ferge76's announcement of success with APCOA. But he's not the OP; the OP's case is still ongoing?
