Stolen Package

I bought an item off ebay last thursday and it was sent the same day. It was delivered on the friday morning by a courier (APC) and they left it with a neighbour.
I was not at home as was working away so did not get back till saturday. I saw the card and asked the neighbour and they deny having received anything.
I contacted the seller and they not taking any respnsibility as they have done their part, they sent the item and its the courier who is at fault.

I contacted the courier on monday morning and they sent me the POD and it does show that my neighbour signed for it, but they still deny receiving any package.

Who is at fault here the seller on ebay?, the courier for leaving it with a neighbour.

I never consented to it being left with a neighbour nor did I did I say I would not be at home, however that should not be the point. The fact is the package was not delivered to my address and I never signed for it.

Advice please....

    Sue the neighbour, you have the proof that they received it.
    Get a copy from the courier.

    Small claims on line. Write yur neighbour a note ie letter before action.

    How much was it worth...

    Nonsense. Unless you gave permission for it to be delivered elsewhere, then it is the seller's responsibility until it's delivered to the address YOU gave them. They must refund you, and then claim that back from the courier. The courier can then sue the neighbour if they choose


    However as it's eBay, just open a claim for item not received
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    Neighbour is always Drunk and High on Methadone.... not shown them POD but asked them if they had anything for me.
    They not the friendliest or non violent type.
    they not got a penny to them, package probably sold and booze bought with it


    its an expensive (£299) gps unit specific for trucks.

    when i bought the item i sent a message through ebay mesage system asking what method of postage would be used as my work hours would make it problematic getting it weekdays.
    they sent message back saying it would be by courier and if i was not in a card would be left.

    No, your talking nonsence, it's perfectly viable for items to be left with a neigbour. Any claim will fail, even paypal will side with the seller and thats saying something.

    Is it? I have no idea if a claim would fail or not, but I don't see it as acceptable if it did. If I owed a shop money and I left it with the shop next door I bet they would still hold me liable for the debt if the shop next door didn't give them the money!

    Unless the OP had given instructions saying it was ok to deliver to a neighbour then I don't see how the seller can have satisfied the contract by delivering it to the wrong address.

    I would go to the police with the POD because the courier wasn't to know that your neighbour wouldn't give it to you. There is a POD so the seller has done his part. Really if you knew that there would have been no one at home, you should have sorted out something yourself. Royal Mail, are now delivering to nieghbours, you will have a job proving different to ebay, because as far as they are concerned the seller has done his job.

    Besides that, Couriers, and Royal Mail, do not deliver on Saturdays unless extra payment is made.

    This is the message I sent to seller when I bought item:-
    hi, i just won this, any chance you could send recorded delivery? and /or first class that way i can collect from delivery office on saturday? as my work patters will be problematic getting it weekdays

    They Replied:-

    Thank you for your message. This item will be shipped via the courier service APC. It will be traceable and you will need to sign for the parcel.
    If you are unable to sign for it then it will go to the nearest depot for you to collect it or re-arrange delivery.
    There will be further information detailing this on the calling card APC will leave if you are unable to accept delivery of the item.


    as you can see i had said getting package weekdays would be a problem, when they replied I presumed they understood the situation and when they said it would be carded and collect from depot it would be ok.
