Dog broke leg in kennels

KILBURN KENNELS NEILSTON NEAR GLASGOW
Winnie my Pomeranian died atKilburn Kennels Neilston, ( Kilburn farm, Kilburnpride border terriers) 2 yearsago, we were told she took heart attack we accepted this. I paid for a private cremation.


However, on the 10thof July 2013, my 9 month old puppy Sienna broke her leg whilst being ‘cared’ for by Kilburn Kennels. The owner ofthe kennel let my three puppies outside in a playpen unsupervised , despitebeing given both verbal and written ( text ) instructions on how to care for mypuppies– how Sienna broke her leg I will never know however I know it happenedin the playpen she was told not to use for my puppies.

Accidents happen , but this ladyis now refusing to pay one penny towards Sienna’s veterinary costs and she isnow refusing to correspond with myself. I had to get police involved andluckily I recorded my meeting with Mrs [TEXT DELETED BY FORUM TEAM] after the incident ( I had to goto her kennel to collect my other two puppies, which Mrs [TEXT DELETED BY FORUM TEAM] initiallyrefused to return to me ). The kennel owners mother can be heard in therecording saying ‘It’s only an animal’ – these uncaring people are in the wrongbusiness, customers pets are family and more than ‘just an animal’ .Theinsurance policy by this kennels is only £500 - Sienna’s vet bill so far is £1800, the break was so severe that my own localVet referred her to an orthopaedic specialist who operated on Sienna thefollowing day .

Lesson learnt the hard way. I trusted this kennelI’m disgusted, distraught by the owners lack of compassion and my puppy has hadto go through traumatic surgery – Sienna was a show prospect puppy and now hershow career is over before it begun. I can just hope the trauma she has gonethrough will not affect her sound temperament. I’ve contacted my legal team andhave contacted the council with regards to her boarding license. The person whoowns this kennels should pay my bill in full as the accident happened whilst inher care. Please folks when you put your wee dogs in kennels, please ensurethey have enough cover should an accident happen, I've found out the hard way.
Does anyone have advice, or has this happened to you ?

    Are you insured or do you have legal protection? either claim your insurance and let them get the money back from the kennels or if you have legal protection (some insurance, union, bank accounts include this) ask them for advice.

    The Kennels insurance arrangements are not your problem.

    The Kennel had a lawful duty of care to ensure the animal was unharmed.
    The breaking of a dogs leg is an unusual and rare injury and usually only caused by the application of extreme force.

    You should write a letter informing the kennel that :

    They had a duty of care that whilst in providing service to ensure the dog was returned unharmed, they failed to do this and as a result the dog has sustained a serious injury through lack of care and neglect, that you hold them fully responsible for this lack of duty of care and for all costs of treatment to rectify the situation caused by neglecting duty of care .

    You shall be making no claims on insurance contracts you are not party to.
    That a claim shall be submitted on an interim basis monthly for the cost of veterinary treatment to rectify the situation with proof of claim evidence for each interim claim.
    That this should be paid in full to avoid further dispute.
    If any dispute arises over payment of treatment required by failure of duty of care legal proceeding will be issued at the County Court.


    You should then forward a prepared invoice on the 28th day of each month for the balance owing plus the costs occurred that month including travel expenses you can prove.
    If payment has not been made interim or in full by the time the treatment is complete you will have to issue a small claim in the county court.
    You will need to provide some proof of claim, this is photocopies of all receipts from vets and travel costs, do not send original documents .

    at the min I have one receipt for 1500 which I payed towards the cost of the op at the specialists and I will have more bills with my own vet. The lady at the kennels took my dog to the vets and signed the consent form, I also have a copy if this agreement, she says as soon as I left her premised with my dog, its my responsibility.

    They can't get much repeat business if they kill or injure every dog in their care.

    Id be doing more than trying to get your vets bill paid, Id be trying to get someone in to look at that place, have you contacted the SPCA and told them of your concerns?

    I would be devastated if a puppy I was looking after severely broke its leg, these people are not suited to the business they run.
