hi,sorry im new to this and not sure im in the right place? anyhow I received a pcn from NGP and appealed on grounds that my slight overstay was due to lack of any disabled parking available and having driven round and round the village the only parking place was in their area (unbeknown to me there was a time limit) I cant travel in a car for long without my sciatica playing hell so once eventually parked I had to lie on my side in the car to relieve the sciatica I then had to proceed to walk very slowly and painfully to my appointment and once back at the car I had to once again lie on my side to enable me to sit up and drive off. I explained all this in my appeal letter and proof of blue badge.the fact I overstayed was purely down to length of time it took me to walk and having to lie down. I did drive around for ages looking for somewhere a lot closer to park first! I didn't see the little sign some 2 shops away on the wall and if I had it would have meant more painful walking right up to it to read it it was very small. they not surprisingly rejected my appeal telling me ' I could have parked somewhere more suitable!!!!!! and the dentists in the village have their own car parks!!!!! im amazed at their cheek. my dentist has space for 2 cars behind and staff take them and IF I could have found a more suitable place to park I flaming well would have. so ive now appealed to the new body but ive since read mitigating circumstances are not allowed? I do fell NGP are being absolute S**** over this the over stay was I think about 15 mins but when you add up the time it took to walk and lie down it all adds up.i pointed out that an able bodies person would no doubt have been back within the time limit so by penalising me they are penalising my disablitiy but to no avail. so what next do you think?? will my appeal be likely chucked out? and if so do I just ignore from now on? or is there another route considering my reasons and their cold hearted response to it? I am hoping it just goes away but a friend just landed hefty court costs from a hospital parking company that took him to court without him receiving written dates until the day before when he had a letter saying you are in court! and they won! so I am a little wary now of the ignore route.although that parking company was not NGP... Anyone know do they take you to court? sorry for all the questions I should have thought of this before I happily sent off my appeals:(. thankyou in advance for any hep or advice on this matter

Having suffered with sciatica for years before having an operation to relieve the dreadful and uncontrollable pain I really sympathise with you.
There are really good people on here that will help you with this, especially coupon mad who is an expert on this type of scam.
But are you saying that you appealed to the PPC scumbags, who rejected your appeal, (they are not interested in you at all only your money) and you have now made the an appeal to POPLA using the same points?
If so you will lose that as well and you will need further assistance with this.0 -

Did you get help with the popla appeal? If you are using mitigation instead of legal arguments that takes apart their whole basis of ticketing, you will fail.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

hi, its taken all this time to receive a reply from 'popla' and guess what?you were all right
they said although they sympathise with my reasons it cant be allowed as mitigating circumstances or words to that effect.Told me to pay the £100 asap.Obviously I don't want to do that! I had a full valid reason for the overstay to do with my disability.so basically I am being told because I have trouble walking and was in so much pain, I had to lie down in the car before and after my appointment I had, I neeed to pay.
My argument was had I been able bodied I would have been back to the car within the time limit, as I have worked out how long it took etc etc.So disability is being discriminated against in effect.
Ok so where do I go from here? Im just about to start an open university course and could really do without all this hassle but I guess it has to be done
Someone please advise me what to do next. This time I am asking BEFORE I go writing letters or appealing lol. I just didn't think before to ask firsthad I thought I probably wouldn't be here now asking. But there we are I am

EXCUSE ME!!! Is there really any need to speak to me like that? if you read the posts it actually says I had written off to the appeal BEFORE!!!!!!! I came on here.So no matter how much you shout and be rude to me NOBODY told me not to go mitigating circumstances BEFORE I had put the appeal in. Yes I probably should have come on here first, but it was only a google search that alerted me to this forum. So pretty pointless being rude about it now however well meaning the original may have been it was too late! I had already appealed. thankyou and thankyou to anyone who can actually give constructive advice without being rude. I am actually quite upset by that reply.so much for a friendly place to get advice
I don't want to pay them obviously but neither do I want it to get to court and me know nothing about it until the day of hearing as happened to a friend with the hospital parking people. They stung him big time on the day and they still are despite his mp getting involved0 -
