yes I have read all the posts. and I haven't read anything that convinces me 100% im not going to hear from them.
I wasn't going to do anything about this ticket before reading this forum even if it is a legit company. As I left the car park then came back I wasn't there for over 3 hours at once.
Why don't you just email the DVLA if you don't believe us?
I even give you the email addy in the 'NEWBIES' sticky thread at the top of this forum. Here's an email reply a poster got when they once complained about the DVLA making a stupid error and giving out data to a non AOS member:
''Thank you for your communication. Because of the lack of any specific evidence we have carried out a wider investigation into this matter.
You are quite right that XXX are not BPA members and are therefore not entitled to make enquiries of DVLA. In this matter, the enquiries should not have been made and DVLA should not have supplied the keeper details.
Any tickets relating to xxx that are still outstanding will be cancelled and any payments received will be refunded. xxx will be writing out to customers over the next week or two.
Internally, DVLA are reviewing the failure in its internal processes where the Operating Instructions were not followed. We have had four requests in this regard which have involved 74 keeper records of which 28 vehicle keepers are due a refund.
We have reported this breach to the ICO and taking disciplinary action against the DVLA personnel involved.

I got a 'ticket' in the same South car-park in the last week or so.
I was about to send them £30 as they say they will charge £80 if they do not receive the £30 within 14 days... but then I came here and saw this thread.

You can also send an email to the dvla saying that they must not release registered keeper details to this non BPA AOS member, and if they do they will be acting unlawfully, so you want to know if any details have been requested, and the date of that, and who exactly has asked for the details.

What would you actually write in such an email to the DVLA Stroma? (Sorry if this sounds a numpty question).
Is it a case of simply telling them your name, address and vehicle licence number and tell them, as you said above, not to give out any of the registered keeper details to this non BPA AOS member?
Would you name the firm specifically who had issued the fake PCN or just leave it general and tell them not to give details out to ANY non BPA AOS member?
Would you also go that one step further and remind the DVLA that it is illegal for them to do so?

There are now two ATAs that the members can get dvla access, the IPC and BPA , but if a parking company is not a member then it would be unlawful for the dvla to release data to them, so yes I would remind them of their obligations, they actually have confirmed that they would not release data a number of times.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. As I recall, a PPC (or anyone for that matter) does not HAVE to be a member of an ATA to access keeper details from DVLA, they just need to have "reasonable cause".
ATA membership simply allows them electronic (hence cheaper) access to keeper details.0 -
No you are wrong, if they are a parking company, they MUST be in an ATA for keeper details, otherwise what would be the point of the AOS in the first place? Refer to Page 4 of the document called 'Release of information from DVLA’s registers' (Google search - unfortunately as a newbie I cannot post links) which sets out when the DVLA will pass information to management companies.0
