Now your splitting hairs, you were wrong to say that you wouldn't query it with HMRC...admit it.

No, I am not giving general advice here, I am giving specific advice to the question the OP posed.

Thats how the rights forums work.

I would definitely query it with fedex. If no charges should have been made, I doubt HMRC with refund the Fedex administration charge!

The OP didn't deal direct with HMRC - the op dealt with the courier, its similar to the way manufacturer/retail works on rights.

Anyone reading this might apply it as a general rule.

Im not going to beat around the bush with you any more but I never "dealt" direct with RM apart from paying their invoice as they too pre pay the tax but I still claimed a refund via HMRC.

So in summery according to your information anyone receiving an invoice for imported goods from fedex can tell them to go away as the sender will have to pick up the tax bill and unlike RM you get the goods before the fedex invoice...excellent news all round and I thank you for it.

Did HMRC refund RM's handling fee too?

According to the FedEx terms and conditions that is exactly right. If the recipient refuses the shipper should be liable. if the shipper proves you agreed to accept the fees due (like those terms and conditions when you order from them for example) then FedEx will revert back to you for the money and would refer it to debt collection if it wasn't paid.

I wondered when you would point out that little extra nugget of information.
So the OP has their backs against the wall with all this "dont have to pay/get a reassessment/query fedex" and their best option is to pay then reclaim at least the tax part from HMRC.
Took a while to get there.

I guess it all depends on how much the OP likes the person who sent the gift. FedEx can't force OP to pay since no contract was entered into so there are no terms to be bound by. OP can pay so the sender gets no hassle (and then dispute with HMRC because no tax should be due), or not pay and let the sender deal with it.

If I sent someone a gift I wouldn't want the recipient to pay for my mistake.

    *sigh*

Is the friend who sent protected by terms and conditions to prove the recip has to pay it? No.

It was a gift shipment and the shipper messed up the declaration.

Chances are you will find it gets written off before it comes back due to the amounts involved.

Where I'm from no cost is better than £10, glad people like you are around to support big business :D;)

When I've had customs charges, they've usually told me this before they'll give me the package. It seems a bit ridiculous to deliver something then send an invoice later, as the OP has no opportunity to refuse delivery.
Some people would decide not to pay it and to lose the card. OP hasn't been given that choice.
