But your contract commenced last August. I's now 11 months on and you need to give 30 days notice anyway. So unless you are in an 18m contract or have altered your tariff in such a way as to commence a new minimum trm, there should be no ETC payable anyway.
So the same question-when does your minimum term end?

    Hi macman,

Unfortunately I'm in an 18m contract..

When I signed the contract I already knew I was going to move house after 12 months.. As I said, this is why I asked information about moving house within the minimum term end to the VM sale person.

And he reassured me saying that there wouldn't have been any early disconnection fee if I moved where VM cable service weren't available..

If you don't want to continue with VM at your new address, albeit with VM National rather than VM Cable services, the website is reasonably clear, that early termination charges will apply if still within the minimum term, if the VM person said this wouldn't apply, you may have a case to get them to waive the ETC, but how do you you prove who said what ?, unless they make some sort of goodwill offer, I think you will have to pay the ETC

fredalo - you have made a mountain out of a molehill and more than likely become a known name within Virgin Media.

You clearly have no idea how to complain but from reading your posts and all this "investigation" work, it means nothing. The ICO won't really care.

Remember, you needed to keep VM happy and on your side, therefore you should have played up the "this is what I was told, it should be on my file". You should have asked for a letter or email to compliment your claim.

I would guess you haven't read through Virgin Media's terms and conditions when it comes to moving?
If you'd rather not take your Virgin Media services with you when you move home, you may be charged an early termination fee to end your contract.
If you annoyed them, they're not likely to waive the early termination fee.

    Good luck.

Hi, thank you for your reply.

Just to clarify that the possibility that lies with the statement "you may be charged" is linked to the status of your contract. It means that you will be charged EDF if you are within the minimun terms. You will not be charged if you have passed the minimun term.

It is not a declaration of goodwill or "maybe yes or maybe not, it depends if we like you.."

I just don't understand.. They mis-sold their service to me.. I should have kept evidence, I know.. My bad... But you think I shouldn't be annoyed with them?

I think we're loosing the plot...

My post was aimed to tell my story and to warn people like me to be careful when contracting with VM sales staff. Maybe to help someone not to make my very same mistake..

Do you think that mis-selling services is a molehill? do you think that I shouldn't fight against these despicable selling practices?

I'm not looking for charity.. I'm not asking them to waive my EDF because I don't want or I can't pay... I don't want to be a nice buddy, bow my head and accept their wrongdoing just to save a few quid..

I don't want to complain about early disconnection fee... I want to complain about VM breach of misconduct in relation to mis-selling..

At last.. I can assure you that I have some experience on "how to complain".. and that ICO will be interested with my claim.. I will let you know :)
