    ive not ben in your situ but i have a friend whos new partner wants to adopt the son

    she sought advice from a solicitor who said that the judge will require the consent from both parents for this to happen as and im not 100% sure why but they kinda both have to adopt him its a bit confusing

    now her son hasnt seen his dad for 3 yrs not her fault but the fathers he shows no interest her son calls the new partner dad now and this is off his own back as he has been there for the last 4 yrs

    the solicitor said that once there has been no contact for 5 yrs then the judge can over rule the consent from the father and grant the adoption
    in your case the father still has regular contact so a judge will not be able to justify an adoption
    the ex will need your hubbies consent which he wont grant so she has to prove in some way that its best for the child which she cant and i presume your partner will fight
    if you cant afford a solicitor then speak to the CAB an get as much info as you can i have read about people defending them selfs some solicitors offer a half hour consultaion for free take advantage of this as much as you can

    as for the name change even tho the child doesnt want this if she has the appropiate papper work then she can do it but remember that it doesnt change her

    i allways say that these children grow up and they then start to make there own descisions which cant be stopped by either parent i know its a long way off for you but one day she will come an see ypu off her own accord an the mother wont be able to do anything to stop it
