It sounds to me like it would hinge on the call recording when you called to get the PAC code. If they advised you that you needed to use it otherwise the contract would continue then you don't have a leg to stand on (this may have been via an automated message). I'd be very surprised if they didn't tell you this, you may just have missed it.

If they didn't tell you then you might have a case I'd suggest.

It might be that i thought that pack code will expire if not in use but not contract will go on, what i really want to chace is a record of 9 june when i talk whit them and guy on phone said i will not need to pay anything and he will close it same day and then 11 june i got final bill of 1 pound

Sorry, I was also commenting on an Orange thread, and in my tiredness, got a little confused.

It needs to be addressed to the Data Controller, however the address is correct.

I think this hinges more on when funds were paid.

If it was at 23.59, the day before the default, then it should be removed.

If it was at 00.01 the day, there's a good chance it won't be, as it will have been correctly issued.

If you can get the 'D' moved to a '1' on the credit file, it won't look anywhere near as bad.

If i do prove to them that they are wrong, and they accept that, can they remove default and how long it will take to remove it?

It must be within a 'reasonable time', which I believe is accepted to be 28 + 14 days (so 6 weeks)

I have seen them removed in less than 2 weeks.

Just to let you know contact 3phone monday about the default ask them to remove it they send request to other department dont remember how they call it and told me to wait 48 hr, call them back today they and got good news it will be removed, went to check my experian account and default has been removed so quickly they done it in one day!!!
Thanks spasyba ,for advice to some !! Just some people are very negative on this site and gives bad advises they should stop doing it!! Like first replays in here was i have no chance and it is my fault... no it was not my fault and i did had a chance..

We didn't have the information we needed, and only upon further questioning have we got this.

On the face of it, the default looked correctly issued, however when we had the correct info, it was easy to see that it wasn't.

Well done on getting it removed.
