    And as I said, just because the OP has got an OFCOM reference number will not make the slightest difference from if they were to complain through the normal channels - ***apart from maybe speaking to the Executive Office in less time***


    Spot ON, properly recorded Ofcom complaint & TIME is MONEY ! 2 birds one stone !
    SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe ;)

    It's doubtful they can process things quicker than already has been requested though so it's irrelevant how quickly you speak to them in that respect.

    And as i said, I don't disagree that OP should complain and yes, to the executive office but I really don't think this warrants small claims and cancelling contracts which is what OP wants.

    Raise a complaint, yes but OP is likely to be without service for 5 days. Admittedly a pain in the rear, but not cancelling contract material. I'm not saying these companies should get away with things but small claims for this situation. What for? They will likely refund and charges he is billed for during the time he is offline.


    Parts of the contract is for (can include/exclude as per contract basis) sim, handset, 'network access' service & CUSTOMER SERVICE, if the OP believes Orange cannot deliver all aspects of the contract they are entitled to request termination as T&C have been broken, Orange paid for private company ADR will not agree with that but £35 and a small claims court certainly can ;)


    Citizens advice is (free and) impartial as is a court, is your non complaints code of conduct policy 'recording' regulator Ofcom or your Ofcom licenced telco as impartial ? ;)

    And I don't disagree with this in prinicpal but the onus is on the customer to prove this breach of contract. i don't think one instance of 5 days without service for what is an error will get OP anywhere. And my experience leads me to believe, as i said before, OP still only has 2 hopes.

    OP is abroad (which a court will put more in favour) with no signal, if the payments are up to date and roaming previously enabled or activated prior to leaving UK, even IF Orange get it sorted with one call in 5 minutes - the breaches of contract have ALREADY taken place, the consumer has no faith in Orange as much as Orange have no faith in their own contract T&C.

    The customer is not barred from 1 roaming partner in the country due to some technical error, but ALL roaming partners, just because roaming MAY have to be activated does not mean it is not part of the contract as a whole as set out by the T&C.

    Orange failed. Consumer wants to enforce their right of termination due to the breach/es of contract.

    How have the breaches already taken place? The networks never guarantee continuous fault free service?

    They agreed by activating roaming to allow that part of the service in the terms of the contract, they failed to deliver the roaming service. BREACH. Why what or how it happened is Orange's problem how it now resolves it, if the OP wants to persue termination they can, Orange can refuse. On the grounds of the facts as we know (and very little) the OP does have a right to ask a court to make a ruling on termination if Orange refuse such.

    No one or company is judge, jury and executioner above Her Maj Courts and Tribunal Service, and if the OP wants to persue that they should, they certainly have enough to get a judge to look at the facts before it may or may not be threw out of court. £35 to get that official impartial legal opinion is a hell of a lot cheaper than buying the contract out for Orange failure/s.

    OP should get all facts and go to Citizens advice or a lawyer (legal aid or OP paid), as it stands for what we know there is a breach of contract to provide service.

    It's nothing to do with Roaming though?

    It is the fact that OP was transferrred to EE from Orange and his old SIM has stopped working.

    I agree, get free impartial advice but without knowing all of the facts it is hard to know whether what has happened constitutes a breach of contract.

    "If that was relevant I would have explained before but if you must know I was offered a new contract with EE which I declined however they sent me a new EE sim card anyway, I called Orange & told them I didn't want the new contract and they said sorry just throw the new sim card away. 3 weeks later my phone was cut off, they had transfered my account to the new EE sim card which I never wanted in the first place and now I must wait until they reconnect my old sim card, in the meantime I can't use my phone"


    Seems a clear breach to me, EE in one brand or another MIS SOLD a contract OP did not want and they terminated his Orange contract and by doing such terminated his service, that's a breach of contract. SEVERAL infact.


    And it would take a few mins for Orange customer service to be professional and correct THIER mis-selling and error by a call to provisioning & provision a PAC back in to Orange and the Orange sim as PRIORITY... IF they knew what they were doing. Its not brain surgery, its simple and its a EE/Orange standard of its OWN lack of staff training...in a multitude of departments, in AU they do this in a shop while you stand there, a minimum wage member of staff 'training' is authorised and able to complete a PAC REVERSAL provision in a matter of minutes to the old sim or a entirely new one, free of charge, stressless and with a smile on their mug.
