iPod Has Died and It Ain't Looking Good...

    I have just spoke to power play about previous ipod fault, They said because it was not bought from them then the sale of goods act does not apply. Is this correct as it was an insurance claim.

    Where did the replacement ipod that has failed actually come from? If it was supplied by power play (and paid for by the the insurance company) then the sale of goods act still applies. Did you get it yourself and then claim the money of the insurance company or did they source it themselves?

  • It originally came from powerplay and i assume direct line paid them!!!! So i take it then that what i have been told is wrong?

    I went through he insurance, sent broken ipod to them, they did the rest

    If the replacement ipod (if I understand you correctly) also came from power play (not talking about the original here, but where the insurance company got the ipod from) then they are responsible for repairing it. Are you sure the replacement came from power play or could direct line have got it from somewhere else?

  • I sent my old ipod to direct line, they forwarded to power play and they sent me the new one, Direct line paid power play for my new one.

    Well in that case the fact that the money came from your insurance company makes no difference, this is basically a second sale of an ipod to you and they are responsible for its repair. The Sale of Goods Act still applies.
