iPod Has Died and It Ain't Looking Good...

There's no way i'm taking it to court. That's just be over the top and it'd cost me more than it'd be saving.
I'll alert them that I want my item repaired for free under the Sales of Goods Act and if they refuse then I will tell them how very disappointed I am, , and that I will be taking my custom elsewhere in my search my another mp3 player, as will all of my iPod owning friends when their's inevitably conk out! (And that's not even a lie, most of my friends own iPods and they reckon they won't buy another if it dies after such a short time either)0 -

I think £20 is not a large outlay compared to what it'd cost to get it even looked at by someone never mind repaired or replaced. Plus you'd get that back when you win anyway. Very unlikely you'd lose and on the small chance you did for the risk of losing £20 I'd do it. I mean we're not exactly talking lawyers fees here, it's only the small cliams court. It's actually less money than you've already stated you currently have in your original post. This is even if it got to that stage and it rarely does. Why do you think it's over the top, many people go to small claims for much less in value? I don't think I could personally afford to write off the cost of an ipod just because I didn't feel like going through with a small claims case.
Edit: unless of course the moneyclaim online fees have increased but it won't be by much and even then if you can't afford it you can get an exemption."She is quite the oddball. Did you notice how she didn't even get excited when she saw this original ZX-81?"

            Hello,
This thread has been helpful as my iPod died yesterday. I would just like to confirm that I understand a couple of the things that have been said.
I have spoken to Apple and they said that as my iPod is out of warranty it is 20 months old) I would have to pay £166 for repairs.
Does the Sale of Goods act mean I have the right to have the iPod repaired for free?
Because the view of the Apple person on their phone service was - out of warranty must pay or they would not repair it.

The Sale of Goods Act is independant and in addition to any Warranty offered by the manufacturer. The important bit here for repair is that you are entitled to a repair or failing that a replacement by the retailer (this is only Apple if you actually bought the iPod directly from Apple) any time up to six years after purchase. How long exactly is a "reasonable time" to expect the product to last. This is deliberately flexible wording in the law and it comes down to common sense. Considering how much you spent on your ipod would you expect it to last more than 2 years. I'd say definitely yes and I'm sure a small claims court magistrate would agree if it came to that. It seems Apple are particularly arrogant when it comes to flouting the law so it may indeed come to making a case against them but this would still be much much cheaper than paying for a repair yourself. Plus you'll get the court costs paid back when you win (about £30). Apple themselves have stated they are designed to last 3 years and a survey of electrical/electronic product manufacturers found most of them saying they expected their products to last five years so only 20 months gives you an extremely solid case and I think Apple will cave in before it goes to court."She is quite the oddball. Hi, Can anyone help with my ipod. I got my ipod replaced from an insurance claim in may 2006 however due to delivery ( 12.06.06 ) its warranty exp June 07. My ipod has now died and i cannot get this repaired or replaced, i have emailed apple and spoke to consumer relations to help!!! they declined any help as 2 months out of warranty.
For those who dont know apple stores have a genius lounge ( free help ) they could do nothing and confirmed ipod broken, there only help and advice was to do another insurance claim. This i will avoid as another claim will increase my premium. Any help would be great.

Who was the retailer?"She is quite the oddball. Did you notice how she didn't even get excited when she saw this original ZX-81?"

Power Play, It was through a cliam with direct line ins.0
 -
It's the retailer's responsibility to deal with it, not apple's. Speak to powerplay.0

Exactly, in this case Apple have no responsiblity legally at all. Everything earlier in this thread about the Sale of Goods Act here applies to Power play."She is quite the oddball. Did you notice how she didn't even get excited when she saw this original ZX-81?"

I have just spoke to power play about previous ipod fault, They said because it was not bought from them then the sale of goods act does not apply. Is this correct as it was an insurance claim.
