iPod Has Died and It Ain't Looking Good...

After one year and two months. Only a couple of months after the warranty expired to i'd have to pay £116 to get it fixed. Which is appalling, quite frankly.

I am a bit stumped so what do you moneysavers reckon I should do? Repair, replacement iPod or another mp3 player?

I don't have very much money at all (about £25 at this precise moment) but if I save there will be more soon.

Sorry if this is the wrong forum, i'm very new and rarely venture outside the competitions forum!

Ipods do have this problem often. Usually it is after about 2 years though. I still have my Ipod 30gb Video and if i had not got that given to me to replace my 20gb generation 4 (i think) ipod by PC World as it was still in warrenty i wouldnt have splashed out on another pod. Yes they do look the best but the software is complecated, The sound quality isnt always the best & putting videos on the thing is really hard. Also you are more likely to get mugged with an ipod as they are more bulky & more desiarble(sp) that doesnt make them the best though. I wouldnt buy another ipod i would look for a cheaper option or even if i had the same money would probably buy a creative Zen Vision as they are apprently much better.

I find that i dont watch videos that often on the ipod anyway so personally i would just go back to an mp3 player but it just depends on what you want. If you want videos there are some perfectly good mp4 players (that arent too bulky) for a decent price. You can get a 4gb mp3 player with FM transmitter for £25 i think it was (posted on here) that looks a bargain and if i was abit strapped for cash like you i would probably go for that.

Ipods are nice to look at but when you own one you realise they are not all they are cracked up to be:rotfl:

Where did you buy it from? If it's only 14 months old then surely you are covered by the Sale of Goods Act and don't need to pay for any repair or replacement. Don't get fooled into thinking that the "warranty period" actually means much in terms of consumer rights.

Unfortunately, the thing was bought from Apple.com. So I can't really go back into the branch or anything. Plus, wouldn't the sales of goods act mean getting legal?

How would I go about saying that I feel they're breaching the sales of goods act? I mean, i'd quite like them to send me a replacement iPod but I don't know how to go about saying that I should get it for free because they're breaching my customer rights.

And how would I go about doing that with a website?!

Regulations to quote are - 'The Sale and Supply of Goods to Consumers Regulations 2002' which says goods must last for a reasonable amount of time.

If it's 5g ipod, will be less than 2 years old, and i'd expect a £220 music player to last more than that as a reasonable amount of time.

The 1 year "standard" warranty and 3 year "extended" warranty does not affect your statutory consumer rights, so these 2002 regs apply above and beyond that.

Apple will obviously check for physical damage that could cause ipod to fail - that's not their fault, but if its a fail in normal use, and no physical damage, they should replace or repair it.

Really?! Because that's what it is really. It wasn't my fault because it's not like I got it wet or dropped it or anything, the thing just stopped working.

Will have to get my dad to write an e-mail or letter tomorrow.

Edit: I'm a little worried that this means I don't have a case. From a description of this act:
    "Fair wear and tear
Goods cannot always be expected to work fault-free. They can break down through normal use. Consumers cannot, therefore, expect to hold the seller responsible for fair wear and tear. There needs to be a fault that was present on the day of sale even though it only became apparent later on, or a misdescription of the goods, or a lack of durability that suggests the goods were not of satisfactory quality to start with."

I would go to an apple store and go face to face with someone it is much easier and a better option you will get a quicker response if that fails then go to apple.com.

Your situation wouldn't be wear and tear as it is an inherent fault that stopped it working through normal use. Remember this law has to cover absolutely everything. A retailer can't be expected to repair or replace something like a car tyre that has travelled 100,000 miles. Trust me you absolutely have a case and if you're worried about the small claims court thing, only a very very tiny percentage of disputes ever reach court. In cases like yours where it's obvious you're in the right it is less hassle both in time and finance for the retailer to just do the repair.

I mean would you really want to pay for an expensive repair or replacement when you're legally not meant to?
