    Contractural parking charge for breach of terms & conditions, i.e. breach of contract. Erm ... does not compute.

    Their attempt to dress up breach of contract (for which only losses can be claimed) as a core contractural term is utterly bogus, and needs to make up the core of the POPLA appeal, when it comes.
  • There still seem to be a lot of "lost" cases at the top of the forum. I know I'm probably jumping the gun here, but why have so many been lost? Were these not done with MSE's help?

    Spot on. That said there were a few early ones purposely collected by regulars to test the system that were lost. This was how MSE and Pepipoo learned the system.

    According to POPLA's own figures something like 60% of appeals succeed. That figure will be much higher for appeals that are done properly, most of the failures are for people pleading mitigation rather than actually challenging the whole basis of the charge.

    What happens from here on in is very much your choice. No one here is going to force your hand.

    When you make up your mind how you are going to deal with this remember that there are thousands of other people out there who are falling victim to these speculative demands who, for a variety of reasons, do not have the benefit of MSE advice and guidance. You have and all you need is patience. There is ample good advice here to follow that will see this bag of tricks disappear. By your shouldering the wheel we will have closed off (hopefully) or at least contributed to closing off, another ridiculous angle that such companies seek to exploit at this boundary of the law. But no pressure - honestly ;)
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Same company, pretty similar circumstances. Don't add a "me too" to the end of that thread, though. If you want to enlist Pepipoo's help, start a new thread (though you can refer back to the referenced thread).

    As an investment in time here's what I'd suggest is a reasonable expectation from you :

    1. Soft appeal - 30 minutes
    2. Research on POPLA appeals - 1.5 hours
    3. Write POPLA appeal - 1 hour

    Job done. Do you earn £33 an hour ? :p
