this is the wording from the ebay add... remember this was not purchased through ebay he contacted me after the auction ended...
.........the van is used so shows signs of wear and tear so please don't expect a brand new van... It is very clean and shows no signs of rust.....
that's vague enough, tell him to take a hike0 -
Looking back at your ebay selling history, you were selling car parts over a 5 year period (multiple parts for many different motors,) and a judge may well think that because of this you should have had a good idea of the state of the ice cream van that you were selling.0

Gotta say, the more information divulged here, the more sympathy I have for the buyer! The guys obviously not mechanically minded and bought it in good faith that your description was accurate, for which you described as having no obvious signs of rust - which he later finds out the floor is in fact rotting away and the MOT has potentially been wrongly issued (I accept the mot station messed up here but that's not the buyers problem) and the vehicle being potentially unroadworthy (which can be an offence).
You say he bought it outside of ebay, but the description still counts imo.
If he does pursue you via small claims court then I think he may have a strong case. So you could do nothing and hope the guy goes away but if he doesn't it might be worth reaching some common ground.0
