    So you'd rather have the added expense of court, him possibly winning and then the court fees and expenses on top, and a CCJ if you don't pay it?

    take it to court - he has no chance of winning. I know having been on his end of things (and that was with an actual garage!)

    So I take it that you have sent the OP a private message telling them that if they do lose the court case, you will be more than happy to cover all of their legal fees.
    After all, if you think it's 100% definite that they can't lose then you have nothing to worry about have you?

    The buyer purchased a vehicle from a business seller, and this vehicle turned out to be unroadworthy and not as described.
    Even though this may not have been the fault of the OP, a judge may still rule that a refund must be given and that if the OP wants to recover their money then they must pursue the garage that carried out the MOT.

    I'd say that makes it B2B transaction & normal business to consumer rules don't apply.

    I'm leaning towards telling him to take a hike although I suspect it will come down to how you described in the advert. Can you post the actual wording you used?

    theres vans on ebay for £10k + on the same year and older so he has getting it for a very good price to start with
