    No need to do anything tell him sold as seen. As a private sale there is no comeback, his time for rejection was at the viewing stage. As you say he checked it over and drove it away, deal done, he has no claim.

    caveat emptor as they say, buyer beware.

    He's admitted you probably didn't know, so doesn't have a leg to stand on.

    If you didn't know of it, you've done nothing wrong by not mentioning it.

    Erm, not quite sure this is the same scenario as when you sell a vehicle privately. Op sold his commercial vehicle used for business so not entirely a 'private' sale - especially since I assume it been going through his books as a capital allowance and an asset of his business.

    after being nicey nice with him for 2 weeks and assisting him as much as i can i have basically had to be firm and tell him hes not getting his money back and to do what ever he has to do.

    You have given him your answer - leave it and wait and see what he decides to do.

    I'm intrigued that the MOT tester has been suspended. Who did you find this out from?

    Assuming they have acted wrongly, this probably means you have a claim against them. So if the buyer claims against you, you may be able to claim against the garage.

    the guy contacted vosa and they have been out to inspect the van so i rang the garage who motd it to see whats going on... the area manager from my area has gone down to his area to sort something out... the guy who motd it is temporarily suspended pending the inquiry.. if they have missed something when it was motd i just cant see how this is my fault
