    Oh thank you for your replies chaps...I was getting quite despondent! :o

    The update is that I finally got a new court date for AUGUST....

    I rang to question why it was so long and was told that 'that was good for here'

    No, hang on...*is still despondent* :o

    I really do appreciate that we had nothing to start with but I defy anyone not to listen to Martin on the radio or to read all the success threads and not get despondent when you appear to be the only person NOT winning having done everything as instructed...:D

    Thanks Twinkley! I'll read it again in a minute but my head is currently spinning after having had a phone call off Cobbett's asking for my statements!! She sounded lovely too and I know in my business dealings normally I'd have had a great conversation with her...I feel like a criminal...:o

    So they weren't prepared for my hearing last time and had the court been bothered I should have won the judgment based on that fact alone! Gah!!!

    I told them I'd already sent them for the last hearing by recorded delivery and I've faxed her the receipts and proof of it!! WHY CAN'T THEY JUST GIVE ME THE MONEY!!!

    phoned the court today about my telephone conference and got told i could stay at home and do it.said they didnt have my phone number so they gave me their number and got virtually straight through to them.asked the court what would happen if they didnt arrange it got told its up to the judge.def said i didnt need to goto the court cos dont want the claim struck out.phoned saarchi(or whatever their names are) made sure they had my phone number and also mentioned the social security administration act 1992(thanks Martin) and the fact that the charges were all taken out of my benefits.dont know if its attempt at arbitration but still gonna get the outline of my case sorted out.hopefully its shaken them enough to settle:D :D:D

    My bet is on them applying for a stay so be prepared to object Good Luck
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    Hello Edinburghlass! Hello Stokey (are you a Stokey? I live here too!)

    Well. No surprises. The judge had a letter already practically instructing him to stay...the solicitor just had to confirm that they were wishing that in any case but, and don't laugh, he asked me if I wanted to say anything so I gave them a litany about the fact that I understood courts were fed up to the back teeth of the claims, but this had been my first and I was extremely disappointed that this was going to be the case as Cobbetts had got away with three occasions where I should have won the case by default; that this large amount of money wasn't a 'gift' to me but reimbursement for the hardship Nat West had put us into by ruining our credit file and was to make up for the higher mortgage payments we've had to pay for the last four years....he didn't interrupt and it made me feel a bit better.:o

    Boring stuff about the legal side but here you go...

    He said the test case should be starting in October and that a decision should be reached by December though he said he imagined it may be a bit longer.
    He instructed Cobbetts to send me a statement of claim by the end of September and no more than six weeks after the outcome of the case that Nat West should send me a summary of the outcome of the case in no more than 500 words with a list of proposed directions for me.

    14 days after that he said they were to make me an offer if that was the outcome of the test case or directions to take the case forward and gave both parties permission to apply.

    I've had a bit of a blart and need to eat some breakfast and have a cup of tea...what I actually wanted to say was it was all a bag of **** :o

    I'm so sorry, I had hoped with it being NatWest that they would have settled.
