Telephone conference hearing???

I've got a date for my £12K Nat West charges claim on 07.06 in my local court.
By TELEPHONE CONFERENCE???

It says the Defendant's legal representative is ordered to arange it.

Is this a new way for the courts to get the bank's solicitors to turn up or pay up beforehand, do you think?

Where's Mister Hamster!!!:o

It would certainly be a novel way of forcing them into the court arena. I doubt the bank will participate in this telephone conference and I'd like to read about what happens after the event if you would be so kind as to post. Thanks and good luck :)

Oh Twinkly...I'm so fed up. I keep thinking my case will be the first to go tits up and I do try and follow everyone else's threads but keep finding things that aren't similar to mine so start a thread.:o

The court haven't asked me for anything so I have just got to turn up...no legal representative or anything? :o

    It's just so much money, I don't want to make a mistake...._pale_

Have you tried contacting Natwest again? My guess is that they will be looking to settle with you before this conference takes place.

Try calling whoever it is dealing with your case at Natwest & ask them about how they will arrange the conference. What's the betting they try to settle with you???
Thanks to all who post comps :A :T

I can appreciate how you feel but try and think positive. At the moment there seems to be a flurry of new ways of dealing with the cases and this can be attributed to the sheer number of cases going through the system and the judges trying to find ways of getting them dealt with quickly and efficiently. It would seem the method employed in your case is another attempt to find a happy medium. It seems you will be one of the first to be dealt with in this manner and it will be a learning experience that you can pass on for others information and encouragement.

I havent seen this posted anywhere else either although to be honest with the children off school for half term my pc time has been limited to snatched breaks and I havent been that efficient on the forum myself this week. If someone else has seen this perhaps they can help better and I do hope someone can give you some advice as to how this may pan out.

Personally I would hazard a guess that they will not participate and will offer a settlement in advance of the conference date. The Berwick case was a lucky fluke ( in my opinion and without getting too technical about the ins and outs ) and the banks have paid out since.

In the interim you should get together a court bundle as, if it does get to a hearing, you will need all the information at hand whilst on the telephone. With regard to legal representation that would have to be your choice. I would wait a little and see if the banks intend going through with this. You will know if they dont when a settlement offer turns up.

A guide to preparing a basic court bundle can be found on CAG here:

Or as Rachel said you can ring them and see if they want to settle :rotfl:

I had my head down typing so long I didnt see it, how simple a solution - I hope it works :)

Oh well! Nothing changes!! Kept in a queue since I last posted and then mentioned the court date and conference request and she said that once it had gone to court they weren't able to help on that number and hadn't got the one I needed...Byyyyyyyyyyyyye!! ;)

Oh well.. I still think they will attempt to settle beforehand. Prepare the court bundle just in case then and see what happens. Dont spend too much energy worrying about it though its not worth it. :)

    Humph.

I just spoke to the court because I am pooing my pants :o and have heard nothing from Cobblers about setting up the telephone conference which is a Court Order for THEM to arrange.

They suggested I ring Cobble-its myself to give them my number (I don't have to attend court and I don't need to do a court bundle  ) so I said as they haven't contacted me and IF they didn't, would I win the case and she said that would be a 'judicial point'...

    Waaaaaaaaaaaaaaaahhh....

Do I let them default on the court order or do I ring them up people????
