Telephone conference hearing???

    Its down to Cobbetts to arrange the hearing as ordered by the court. You should be relaxing and leaving them to it. Why would you help them to do a job theyre being paid to do for the other side ? :rolleyes:

    As regards what happens if they fail to obey the courts instructions I dont know. Yours is the first I've heard of such a direction and I am watching to see what happens :)

    keep strong funkylala. Its what they are hoping for - you to break. Thinking of you and let us know what happens. Maybe afterwards when we can all laugh about it - the press would have a field day after the positive press for banks recently with a couple of freak wins.


    Might be worth trying to see if you can seek legal advise on this site, either way.

    Would you believe they hadn't got a clue about the court order, asked for my number and promised to ring me back...........and never did!!

    I promise to keep my pesky fingers off the telephone dialling pad and I'll just have to have a stiff drink at 12.10 Thursday to see what befalls me...

    I feel like I've robbed the bloody bank myself! :o

    Well I rang the court and Cobbetts on Monday and Cobbetts never rang me back.
    I faxed the court yesterday to inform them that Cobbetts
    1. said they'd not had the court order and
    2. that they said they'd ring me back and didn't...

    Rang the court this morning to say I'd STILL not heard and the court clerk said the fax had been passed to the judge and my call would also be noted; I asked if the telephone conference didn't come about if I'd win by default again and sahe still said it was the judge's decision.

    I said do I ring back after the hearing was due and she said the papers wouldn't get back until later and maybe not for the next couple of days...

    BIZARRE.:confused:

    They did not ring.

    God! I really feel for you.

    You have to realise that the way the bank are playing this is specifically designed to frighten off people of a nervous disposition.

    All I can say is be patient.

    I can't guarantee that everything will turn out as you wish but I suspect that the probability it does is extremely high.

    Please don't forget to post when you do get a result.

    Oh give me strength! Is it me or is this TOTALLY out of order?

    Just rung the court for the judgment and they've ADJOURNED it for 14 days.

    So. They didn't reply with their defence til I'd put the judgment in FIVE days late myself and got the judgment filed.

    Then they disobey a court order to arrange a telephone conference and the case gets adjourned????:confused:

    Might just be me thinking out aloud, but normally cases could be adjourned for a number of reasons, but you could ask why? At the end of the day, perhaps they need to wait for more time, but there is normally a good reason "judge goes on holiday etc".

    Have read through the entire thread, and its obvious to me, that everyone is backing you up 110%. Keep going and good luck

    OK chaps....I'm bumping this thread as you've asked me to keep you up to date but I would appreciate any feedback from anyone knowledgeable in the court process because obviously, being helpful, I've jiggered the last court hearing because I asked the court clerk today for the reason for the adjournment and it is because I told them that Cobbetts hadn't done anything to arrange the phone conference. When I asked the girl why that wasn't seen as some sort of contempt of a court order instead of giving them more time she got a wee bit flustered and said that if they did it again the judge 'would have to do something about it'...
