Used car faulty but garage refusing responsibilty

    Question surely begs; what is the true recorded mileage as far as you were made aware? Was any mileage given in any advertising... if so what was it? Does the mileage correspond with the MOT history?

    The mileage issue could turn your whole case on it's head in your favour depending on your answers.

    The mileage was advertised at 50000, the clock reads 29000 but the MOT history shows it as 65931.
    Here is what the MOT says, in case I am missing something here:
    10/2009 - 37667
    01/2011 - 19177
    06/2012 - 27733
    06/2013 - 28264

    Also, another question (sorry) but if I have to wait 14 days for a response from the garage to my letter, what I am suppose to do in the meantime? I can't drive around in a car that needs new brakes but I can;t have it fixed as that doesn't give them the opportunity and would maybe stop me from being able to go to court to claim back.

    So in 2011, the mileage decreased by almost 18,500 miles? And now it reads 36,000 less than what is shown in the MOT history but was advertised as having done 50,000 miles?

    Were you not given an explanation for this by the seller?

    No, no explanation given at all. TBH, with it being lower than advertised we thought we were getting a better deal.

    I don't know what to do as they won't repair it, never mind take it back. We really like the car (minus the faults!) and if we take it back will be without a car and having to rush to find a new one.

    Is there any other action?

    I have been advised to write a complaint about faulty goods letter but it's not much help when I need a car for work and to go on holiday - the main reason we bought a 7 seater.

    I did read - infact it wasnt until post 14 that you bothered to mention to us that the mileage was wrong.

    As that wasn't the issue I was asking about and I only mentioned it when I was asked about the mileage. I had started a different thread about the mileage inconsistency.

    Regardless of mechanical issues, just reject the car due to the mileage issue. Is it an Espace? They are know for speedo faults.
